a. Award a contract to The Don Chapin Company, Inc., the lowest responsible and responsive bidder for the Castroville Drainage and Road Improvements between Union Street and Poole Street, Project No. 13-142465, in the total amount of $135,506.50;

RECOMMENDATION:
It is recommended that the Board of Supervisors:
 
a. Award a contract to The Don Chapin Company, Inc., the lowest responsible and responsive bidder for the Castroville Drainage and Road Improvements between Union Street and Poole Street, Project No. 13-142465, in the total amount of $135,506.50;
 
b. Approve the Performance and Payment Bonds executed and provided by The Don Chapin Company, Inc.;
 
c. Authorize a contingency (not to exceed 10% of the contract amount) to provide funding for approved contract change orders;
 
d. Authorize the Director of Public Works to execute the contract and, subject to the terms of the Public Contract Code, approve change orders to the contract that do not exceed 10% of the original contract amount, and do not significantly change the scope of work;

SUMMARY/DISCUSSION:
On March 19, 2013, the Board of Supervisors adopted the Plans and Special Provisions for the
Castroville Drainage and Road Improvements between Union Street and Poole Street, Project No. 13-142465.  The project is to construct improvements on Alley 1CV51, between Union Street and Poole Street; and on Union Street, in front of Castroville Elementary School, between Alley 1CV51 and Merritt Street.  The Project was advertised and the bids were opened on April 11, 2013.  The lowest responsible bidder is The Don Chapin Company, Inc. with a bid in the amount of $135,506.50.  The Engineer's Estimate for the bid was $196,319.  Project construction is scheduled to begin July 2013, with completion anticipated by September 2013.
 
The Project consists of pavement reconstruction with hot mix asphalt concrete; including but not limited to concrete sidewalk, curb and gutter construction, pavement markings, and pedestrian ramp construction.
 
Upon further coordination with Castroville Community Service District (Castroville CSD), supplementary work was requested by Castroville CSD that requires additional paving on Union Street and Poole Street.  Originally, the project was to conform to the centerline of both streets.  Castroville CSD requested that the project pave from curb to curb.  County staff looked at the existing road condition and agreed with Castroville CSD that public safety in front of Castroville School will benefit from repairing the failed pavement.  Change order number 1 is requested in the amount of approximately $31,000 to address the additional paving.
 
Once the contract is complete in all respects in accordance with the Plans and Special Provisions, the Director of Public Works will accept the Certification of Completion for the construction of the Project and execute and record the Notice of Completion with the County Recorder's office.
 
The Project has been determined to be categorically exempt (Class 1) from the California Environmental Quality Act (CEQA) because it is to perform repair and maintenance of existing streets and sidewalks, which involves no expansion of an existing use.  (See CCR Section 15301, Existing Facilities)
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Contracts/Purchasing attended the bid opening and reviewed all bids for conformance with applicable regulations.  The Office of the County Counsel, Auditor-Controller, and Risk Management have reviewed and approved the contract documents as to form and legality, fiscal terms, and insurance provisions, respectively.  The Castroville Community Services District is in concurrence with the project.
 
FINANCING:
There is no financial impact to the General Fund.  Total estimated Project cost, engineering, construction management and construction, is $362,029.  The Project is funded by the Road Fund in the amount of $362,029.  There are sufficient appropriations in the Road Fund (Fund 002, Unit 8195) to finance this Project for the work anticipated in FY 2013-14.
