RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the County Purchasing Agent or their designee to execute Renewal and Amendment No. 1 to the Direct Service Provider Agreement with Atlas Organics CU11, LLC, to extend the term for a new term of May 4, 2023 through December 31, 2026; and
b. Approve and authorize the County Purchasing Agent or their designee to approve up to two future amendments that do not significantly change the scope of work.
SUMMARY:
The County of Monterey (County) and Atlas Organics CU11, LLC (Atlas Organics) entered into a Direct Services Agreement (Agreement) to incentivize residents and Salinas Valley Solid Waste Authority (SVSWA) rate payers (Public Purchasers) to acquire recovered organic waste products, which will ensure the County remains in compliance with California Code of Regulations (CCR), title 14, sections 18993.1 through 18993.4 (“SB 1383 Regulations”).
DISCUSSION:
The Direct Services Agreement between the County of Monterey, a member of the SVSWA, and Atlas Organics, executed on May 3, 2024, was established to encourage residents and Public Purchasers to obtain recovered organic waste products in the form of finished compost or mulch from Atlas Organics.
Senate Bill 1383 (SB 1383) requires counties to annually procure recovered organic waste products based on a per-capita target. The County meets this requirement through a direct service provider. Under this Agreement, Atlas Organics facilitates compliance with SB 1383 by offering compost and mulch to residents and Public Purchasers at a discounted rate, thereby increasing access to and use of recovered organic waste products. Atlas Organics provides monthly reports set forth by CalRecycle evidencing procurement for the compost or mulch for annual reporting purposes. The original Agreement term expired on December 31, 2023. This Renewal and Amendment No. 1 extends the Agreement term through and including December 31, 2026.
This work supports the County of Monterey Health Department 2025-2028 Strategic Plan Goal: Deepen Organizational Effectiveness and Support Long-Term Sustainability. It also supports the following of the ten essential public health services, specifically: Enforce laws and regulations that protect health and ensure safety.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller’s Office have reviewed and approved as to form and fiscal provisions, respectively.
FINANCING:
This Renewal and Amendment No. 1 to the Agreement is at no cost to the County. There is no impact on the County General Fund.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
The procurement of organic waste into compost and mulch reduces landfill waste and greenhouse gas emissions, supporting environmental sustainability. It also improves soil health and promotes a circular economy, benefiting agriculture and strengthening local economic resilience.
