RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Authorize the Chief Contracts and Procurement Officer or designee to execute Amendment No. 1 with Liberty Vote USA Inc., formerly named Dominion Voting Systems Inc., to provide equipment maintenance, software updates and support services for the Elections Department’s mobile ballot printer and redundancy back-up voting equipment, extending the agreement for six (6) additional years for the term retroactive to January 1, 2026 to December 31, 2031 for a revised full agreement term of August 1, 2020 through December 31, 2031 and adding $67,247 for a revised aggregate total amount not to exceed $95,928.
SUMMARY
The Elections Department is requesting to extend the software, maintenance and support services for the Department’s mobile ballot printer and add the emergency redundant voting equipment with Liberty Vote Inc., (the Vendor) through Amendment 1 effective upon approval.
DISCUSSION:
In 2020, the Department obtained grant funding to purchase mobile ballot printing equipment and licenses to provide ballots to voters and create a safeguard for ballot supply levels during the early voting period through Election Day. The Agreement’s non-standard terms and conditions were approved by the Board in 2020.
In 2025, the Department utilized a security grant to procure back-up redundancy voting equipment. This equipment serves as a contingency for the current tabulation system, ensuring continuity of operations in the event of displacement from the central count location. The equipment will facilitate continued vote counting as required by law.
To maintain cost-effectiveness and operational efficiency, the Department must retain this vendor for maintenance and software support. The equipment is critical to the processing and printing of ballots, ensuring integrity, reliability and proven election-tested performance for both past and future elections.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
County Counsel has reviewed and approved as to form and by the Auditor-Controller regarding fiscal provisions.
FINANCING:
Funding for this agreement is incorporated into Elections FY 2025-26 budget. Funding for subsequent years will be incorporated into future budgets with portions of the cost to be allocated to jurisdictions during an election.
