RECOMMENDATION:

It is recommended that the Board of Supervisors:

Approve and authorize the Director of Health to sign a service agreement with Weber, Hayes & Associates, Inc. in the amount of $2,935.00 for the period of July 1, 2013 to September 30, 2013 for the development of a soil vapor intrusion plan for required screening in response to the Water Board’s approval of the additional soil vapor sampling tasks in their directive dated June 28, 2013.  This project includes field planning and inspections to assess potentially impacted structures and collection of the required sub slab vapor samples.

 

SUMMARY/DISCUSSION:

The Environmental Health Bureau (EHB) entered into a Services Agreement with Weber, Hayes, & Associates, Inc. (WHA), effective November 14, 2011 to June 30, 2012 for the purpose of installing down gradient monitoring wells, sampling and assessments associated with property at 53 Porter Drive, Pajaro, CA.  A subsequent amendment extended the agreement to June 30, 2013.  On June 28, 2013, the California Regional Water Control Board requested the Monterey County Environmental Health Bureau to conduct soil vapor sampling tasks on property located at 53 Porter Drive, Pajaro, CA, for the purpose of developing a soil vapor intrusion plan for screening of down gradient buildings located in the footprint of the high concentration benzene plume.  This project included field planning and inspections to assess potentially impacted structures and the collection of required sub slab vapor samples. 

 

Weber, Hayes & Associates, Inc. coordinated with regulatory agencies, prepared a budget and provided Emergency, Abandoned and Recalcitrant Account Cost Pre-Approval Request support for the assessment.  During the course of this initial planning work, the abandoned 53 Porter Drive, Pajaro, CA property was sold via auction by the County of Monterey.  It is anticipated that the California Regional Water Control Board will be naming the new property owner as the responsible party for continued investigation. The Monterey County Health Department will no longer be acting as the responsible party managing the EAR Account for this regulatory required investigation.  As a result, WHA halted the current planning activities and submitted the costs incurred for reimbursement. 

 

Prior to the June 28, 2013 request from the California Regional Water Control Board, the EHB assessed all agreements for Fiscal Year 2013-14 and determined that services provided by WHA had been completed and the agreement did not require a second amendment or renewal.  Therefore, an amendment to extend services was not initiated.  However, due to the timing of the end of the agreement and the request for further services, WHA was authorized by EHB staff to conduct services, unaware that the agreement had not been extended for Fiscal Year 2013-14.  EHB became aware of the services rendered upon receipt of an invoice from WHA as mentioned in the above paragraph. 

 

In order to pay for the services rendered, a new agreement is submitted for Board approval.  The Agreement term of three months is to cover services rendered in Fiscal Year 2013-14. 

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed and approved the Agreement as to form and legality, Contracts Purchasing and the Auditor-Controller has reviewed and approved the Agreement as to term and fiscal provisions

 

FINANCING:

There are sufficient appropriations in the Health Department Environmental Health FY 2014-15 Adopted Budget (4000-HEA005-8116) to cover this expenditure and will have no financial impact on the General Fund.
