Approve and authorize the Director of Health Services or designee to execute a Contract for the Provision of Services with The United Way of Monterey County, retroactive to September 1, 2023, through June 30, 2024, for the provision of Reflective Leadership consultation services and training to Monterey County Children’s Council by the County for a total Agreement amount not to exceed $10,000; and
b. Approve non-standard insurance, limitation of liability, and indemnification provisions to the Contract as recommended by the Director of Health Services; and
c. Authorize the Director of Health Services or designee to approve up to three (3) future amendments that do not exceed 10% ($1,000) of the original Agreement amount, do not significantly change the scope of services, and do not increase the total not to exceed amount over $11,000.

RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute a Contract for the Provision of Services with The United Way of Monterey County, retroactive to September 1, 2023, through June 30, 2024, for the provision of Reflective Leadership consultation services and training to Monterey County Children’s Council by the County for a total Agreement amount not to exceed $10,000; and

SUMMARY/DISCUSSION
Monterey County Children’s Council (MCCC) is a local council that provides leadership and policy direction to encourage the development of a comprehensive and collaborative delivery system of services to children and youth in Monterey County. The Council has committed to embed reflective leadership practice within all the work that is carried out and to support the leadership that makes up the Council membership in developing and utilizing reflective leadership skills. To further this effort, the MCCC has engaged with the County to provide Reflective Leadership facilitation during MCCC meetings from the period of September 2023 through June 2024.
This Agreement is being presented late to the Board due to the nonstandard nature of the agreement and indemnification provisions. Discussion of the appropriate nature of the agreement between the County and United Way of Monterey County that allowed for the County to receive funds as the contractor required resolution before moving forward. These discussions have been resolved and Board approval has been sought immediately after the resolution. The Health Department requests that the Board accept the Director of Health Services’ recommendation to accept the nonstandard indemnification provisions.
This work supports the County of Monterey Health Department 2018-2024 Strategic Plan Goal: 1. Empower the community to improve health. It also supports one of the ten essential public health services, specifically: 4. Strengthen, support, and mobilize communities and partnerships.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively. Risk Management has not approved this Contract due to non-standard insurance, limitation of liability, and indemnification provisions.
FINANCING:
The staff costs associated with the provision of these services by the Health Department to MCCC are included in the Health Department’s Behavioral Health Bureau (HEA012, Unit 8410) FY 2023-24 Adopted Budget.
