Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the County Administrative Officer or designee to execute a Professional Services Standard Agreement with non-standard payment provisions between the County of Monterey and the City of Soledad to develop, build, and manage a 16-bed non-congregate interim housing facility located in Soledad for the purpose of providing temporary living facilities to occupants of an encampment site in an amount not to exceed $1,955,000 for the term January 7, 2025 through June 30, 2027; and,

b. Authorize and direct the Auditor-Controller to issue a payment in the amount of $1,955,000 to the City of Soledad upon execution of the agreement and receipt of a certified invoice; and,

c. SUMMARY/DISCUSSION:

This Agreement with the City of Soledad (“Soledad”) is for the development, construction and property management of a 16-bed interim housing facility funded by an Encampment Resolution Funding Program grant (ERF-3-R), in an amount not to exceed $1,955,000 for term January 7, 2025 through June 30, 2027, to provide temporary housing for the unsheltered individuals currently living at an encampment site located along the Salinas River on unincorporated, public and private lands adjacent to Soledad.

 

In 2024, the County Administrative Office Homelessness Strategies and Innovations Division (CAO-HSI) partnered with Soledad to secure ERF-3-R sponsored by the California Department of Housing and Community Development (“HCD”) to develop interim housing on property owned by Soledad at 990 Los Coches Road, Soledad, California 93960. The goal of this interim housing is to provide low-barrier, temporary living facilities and access to comprehensive services in a housing-focused service model to the unhoused occupants of the Soledad encampment site. The daily operations and services for the interim housing will be provided for by an experienced services provider through a separate agreement with CAO-HSI.

 

This Agreement contains the County’s standard 30-day “no cause” provision in Section 3.02 of the Professional Services Standard Agreement, “defunding” provisions with return of funding instructions in Exhibit A, Sections G.10 and J.3.c., and contains an indemnification provision in Section K. to return any funds used fraudulently or not for the purpose of this Agreement.

 

This initiative correlates to the Health & Human Services Strategic Initiative adopted by the

Board of Supervisors by working collaboratively to address and develop a plan for ending homelessness.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel-Risk Management have approved the proposed Agreement as to form, insurance and indemnification. The Auditor-Controller has reviewed the proposed Agreement but does not agree to the non-standard payment provisions. The CAO Budget and Analyst Division concurs with the Auditor-Controller and has reviewed the proposed Agreement but does not agree to the non-standard payment provisions.

 

FINANCING:

This action does not impact the General Fund. This agreement is funded by an Encampment Resolution Funding Grant (ERF-3-R). Sufficient appropriations and estimated revenues are included in the County Administrative Office FY Adopted Budget 2024-2025 for the Homelessness Strategy and Initiatives Division (001-1050-CAO004-8598).
