a. Approve and authorize the Public Defender, Chief Assistant Public Defender, or designee to execute Amendment No. 1 to the Standard Agreement (A-17316) with Sun Street Centers, including non-standard payment provisions, retroactive to July 1, 2026, to increase the not-to-exceed amount by $170,998 for a total not-to-exceed amount of $2,287,301 with no change to the term of the agreement, allowing continued provision of Board of State and Community Corrections Proposition 47 Cohort IV grant funded substance use disorder treatment services; and
b. Authorize and direct the Auditor Controller to issue a cash flow advance to Sun Street Centers in the amount of $172,006 upon contract execution to expedite provision of Proposition 47 Cohort IV substance use disorder treatment services to eligible recipients; and
c. Authorize the Public Defender, Chief Assistant Public Defender, or designee to execute up to five (5) future amendments to this Agreement, where the amendments do not alter the not-to-exceed amount of $2,287,301 and do not significantly alter the scope of work.

It is recommended that the Board of Supervisors:
a. SUMMARY:
On May 20, 2025, per Board Order No. A-17316, the County of Monterey Board of Supervisors authorized the Public Defender’s Office to execute a Standard Agreement with Sun Street Centers, with a not-to-exceed amount of $2,116,303 and a term of July 1, 2025-June 30, 2028, including non-standard payment provisions, to provide Board of State and Community Corrections Proposition 47 Cohort IV funded substance use disorder treatment services in Monterey County. A portion of the funding under this Agreement is allocated to support an additional three days of staffing and operations at the Salinas Sobering Center, increasing operational capabilities of the facility from part-time to 24/7. As of July 1, 2026, a separate funding source that supported a portion of the Sobering Center staffing and operations is no longer available, and additional funding is needed to ensure continued provision of 24/7 services. To address this funding gap, the Public Defender’s Office and Sun Street Centers mutually desire to amend the Agreement via Amendment No. 1, retroactive to July 1, 2026, to increase the not-to-exceed amount by $170,998 for an updated not-to-exceed amount of $2,287,301, with no change to the term of the agreement.
DISCUSSION:
On November 12, 2024, per Board Order No. A-17152, the County of Monterey Board of Supervisors authorized the Public Defender’s Office to accept an $8,000,000 Proposition 47 Cohort IV Grant (Prop. 47) award with a term of October 3, 2024-June 30, 2028, from the Board of State and Community Corrections, and authorized execution of the associated grant agreement to fund mental health services, substance use disorder services, housing related assistance, community-based supportive services, and additional prevention/early intervention diversion services to Prop. 47 eligible adults and juveniles.
On May 20, 2025, per Board Order No. A-17316, the County of Monterey Board of Supervisors authorized the Public Defender’s Office to execute a Standard Agreement with Sun Street Centers with a not-to-exceed amount of $2,116,303 and a term of July 1, 2025-June 30, 2028, including non-standard payment provisions, to provide Prop. 47 grant funded substance use disorder treatment services. Sun Street Centers is a nonprofit, Medi-Cal certified organization dedicated to preventing and treating substance use disorders in Monterey County, and this Agreement addresses critical funding gaps for the Prop. 47 population, ensuring continued access and diversion for eligible participants.
A portion of the funding under this Agreement is allocated to support an additional three days of staffing and operations at the Salinas Sobering Center, increasing operational capabilities of the facility from part-time to 24/7. The Sobering Center provides an intervention program that administers to a participant’s level of intoxication from alcohol and other drugs in a supportive short-stay environment overseen by qualified on-site staff. The services provided by the Sobering Center save law enforcement time and money, contribute to public health and community safety, and provide an avenue to divert eligible individuals from incarceration and connect them with additional substance use treatment and/or supportive services and resources. Since implementation of 24/7 operations on July 1, 2025, the Sobering Center has seen utilization rates double across all seven days of operations.

OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
County Counsel has reviewed and approved as to form. The Auditor-Controller’s Office has reviewed and does not agree with the nonstandard payment provisions.
FINANCING:
There will be no impact to the General Fund from this action. This Agreement is funded by Proposition 47 Cohort IV Grant funding. The Proposition 47 Cohort IV Grant does not require matching funds.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
This Amendment No. 1 advances the Well-Being and Quality of Life Strategic Goal by ensuring continued access to substance use disorder treatment and Sobering Center services, improving health outcomes and connecting eligible individuals with ongoing supportive services. It also supports the Safe and Resilient Communities Strategic Goal by reducing demands on law enforcement resources while enhancing public safety through diversion and acute intervention.
