a. Approve and authorize the Director of the Department of Social Services to execute an agreement with Excellesoft Partners, LLC, for a subscription license and user fees for an In Home Supportive Services Provider Orientation & Enrollment system for the period of July 1, 2022 to June 30, 2025 with nonstandard indemnification, liability and insurance terms, for a total contract amount of $29,380; and
b. Approve and authorize the Director of the Department of Social Services to sign up to three (3) amendments to this agreement as long as they do not exceed 10% ($2,938) of the contract amount or significantly change the scope of work.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of the Department of Social Services to execute an agreement with Excellesoft Partners, LLC, for a subscription license and user fees for an In Home Supportive Services Provider Orientation & Enrollment system for the period of July 1, 2022 to June 30, 2025 with nonstandard indemnification, liability and insurance terms, for a total contract amount of $29,380; and
b. Approve and authorize the Director of the Department of Social Services to sign up to three (3) amendments to this agreement as long as they do not exceed 10% ($2,938) of the contract amount or significantly change the scope of work.
SUMMARY/DISCUSSION:
The Excellesoft REVA system provides the Department of Social Services (DSS) Adult and Aging Services, In Home Supportive Services (IHSS) Public Authority, the ability to enroll and provide orientations to IHSS providers. IHSS providers assist those who qualify for the IHSS program, low -income individuals who are over 65, have a disability or are blind, by providing personal care services such as shopping, cooking and cleaning. These services allow customers to remain in their home as long as possible.
The Department recommends approval of the agreement with the nonstandard indemnification and liability terms as, while they are not standard to the county, they are standard to the software industry.
OTHER AGENCY INVOLVEMENT:
The Auditor Controller and Purchasing have reviewed and approved this Agreement. County Counsel has approved the Agreement as to form. Risk Management has approved the nonstandard insurance terms.
FINANCING:
Funding is provided by Federal and State revenues and Realignment funds. Sufficient appropriations and estimated revenues for SOC005 are included in the FY 2022-23 Requested Budget. Future costs will be incorporated in the corresponding budget process.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
This agreement correlates to the Health & Human Services Strategic Initiative adopted by the Board of Supervisors by supporting the ability of low-income seniors and persons with disabilities who need personal care assistance to remain in their homes.
