b. Direct the County Administrative Officer to file the approved response with the Presiding Judge of the Superior Court, County of Monterey, by September 25, 2020.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Consider approval of the revised response to the 2019 - 2020 Monterey County Civil Grand Jury Final Report "MONUMENT TO A FAILED PROCESS: South County Use Permit PLN 180317"; and

b.                     Direct the County Administrative Officer to file the approved response with the Presiding Judge of the Superior Court, County of Monterey, by September 25, 2020.

 

SUMMARY:

The 2019 - 2020 Monterey County Civil Grand Jury Final Report "MONUMENT TO A FAILED PROCESS: South County Use Permit PLN 180317" was issued in June 2020.  By law, the Board of Supervisors and elected County officials are required to respond to specific findings and recommendations as directed therein.  Within 90 days of report issuance, on or before September 25, 2020, the Board’s response must be filed with the Presiding Judge of the Superior Court, County of Monterey.

 

On September 15, 2020 the Board of Supervisors reviewed the draft response prepared by the Director of Resource Management and directed that he modify the response and return to the Board for final approval on Sept 22, 2020.

 

The Board of Supervisors’ approved response should be deemed by the Monterey County Civil Grand Jury and the Presiding Judge of the Superior Court, County of Monterey, as the response of the Board of Supervisors to those issues raised by the Jury regarding "MONUMENT TO A FAILED PROCESS: South County Use Permit PLN 180317".

 

OTHER AGENCY INVOLVEMENT:

The County Administrative Office coordinated preparation of the recommended response to the 2019 - 2020 Monterey County Civil Grand Jury Final Report "MONUMENT TO A FAILED PROCESS: South County Use Permit PLN 180317" with the assistance, input and appropriate review by the Resource Management Department.     

 

Members of the 2019 - 2020 Monterey County Civil Grand Jury were invited to attend the Board of Supervisors hearing on this matter.

 

FINANCING:

There are no fiscal impacts to the General Fund with this recommendation.
