RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Approve agreement with Smith & Enright Landscaping, Inc. to provide litter abatement services within the County of Monterey, Request for Proposals (RFP) #10957, for an initial term of three years effective May 1, 2026 to April 30, 2029, with the option to extend the term for up to two additional years, for an amount not to exceed $1,250,000;

b.  Approve additional term extensions for the agreement beyond the anticipated five-year term of RFP #10957 with no change in the scope of work or increase to the dollar amount to allow continuity of services initiated during the anticipated five-year term of the agreement, subject to review and approval as to form by the Office of the County Counsel; and

c.  Authorize the Director of Public Works, Facilities and Parks or their designee to execute the Agreement and future amendments to the agreement where the amendments do not significantly alter the scope of work or increase the compensation.

 

SUMMARY:

The County of Monterey (County), Department of Public Works, Facilities and Parks (PWFP) has identified a need for litter abatement services to address illegal dumping of household, commercial and industrial waste items on County roads and public lands, including but not limited to waste collection and illegal dumping mitigation throughout the County of Monterey and extraordinary services such as the collection and disposal of homeless encampment debris.

 

The recommended actions will establish an Agreement with Smith & Enright Landscaping, Inc. (Smith & Enright) to provide litter abatement services within the County. 

 

 

DISCUSSION:

The County operates the Litter Abatement Program (Program), which provides for the collection and disposal of litter, debris, and materials dumped illegally along County roads and public rights-of-way and on public lands.  The Program operates seven days a week and removes 400-500 tons of household and industrial materials from County roadways each year.

The Program is a partnership between PWFP and the County Health Department’s Environmental Health Bureau (EHB), Salinas Valley Solid Waste Authority (SVSWA), Monterey Regional Waste Management District dba ReGen Monterey (ReGen Monterey), and contractor(s) with multiple components.  EHB and PWFP will work with SVSWA, ReGen Monterey and Smith & Enright to provide more frequent community cleanup days County-wide.  EHB and PWFP will also work with the Program partners and contractors to provide for additional cleanup events and expanded road cleanup services.

 

On November 20, 2025, PWFP solicited Proposals from qualified consultants through Request for Proposals (RFP) #10957 for litter abatement services.  On January 8, 2026, PWFP received Proposals from two consultants.  The proposals were subjected to a competitive selection process that was conducted in accordance with County policies and State and Federal laws under RFP #10957.  As a result of this competitive process, Smith & Enright was selected as the most qualified consultant for their expertise and capabilities in providing litter abatement services.  

 

Board of Supervisors (Board) approval would allow for the issuance of an agreement between the County and Smith & Enright to provide litter abatement services, for an initial term of three years effective May 1, 2026 to April 30, 2029, with the option to extend the term for up to two additional years, for an amount not to exceed $1,250,000. 

 

Attachment A is provided for reference and includes a draft of the proposed agreement.  Attachments B through D include RFP #10957 and Addendums No. 1 through 2 to RFP #10957.

 

OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:

The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved the agreement as to form and fiscal provisions, respectively.  The Program is a planned cooperative effort among PWFP, EHB, SVSWA and ReGen Monterey and contractor(s) with multiple components.  In addition, the Program includes coordinated efforts with contractors such as Waste Management, Inc.

 

FINANCING:

Costs associated with the agreement are anticipated to be incurred over the next four fiscal years (FYs): 2025-26, 2026-27, 2027-28, and 2028-29 through April 30, 2029, with the option to extend the term for up to two additional years.  The FY 2025-26 Adopted Budget for the Litter Abatement Program, Fund 001, Appropriation Unit PFP002 includes $225,000 in appropriations for this agreement. Beginning in FY 2026-27, $250,000 has been incorporated into the baseline budget to support ongoing program costs and will continue to be included in each subsequent fiscal year. Funding is provided from Memorandum of Understandings (MOUs) with SVSWA (Agreement No. A-16366) and ReGen Monterey (Agreement No. A-16365) totaling $150,000 and Transient Occupancy Tax in the amount of $100,000.

 

If necessary, additional actions relating to homeless encampment cleanup (services also included under the agreement) will be brought before the Board once funding has been identified. 

 

BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:

The recommended action supports the Board’s Strategic Plan Goals by enabling PWFP to continue essential litter abatement and cleanup services that promote a clean, safe, and well-maintained County.  With only two Litter Guards and limited support from the Work Alternatives Program, PWFP will depend on Smith & Enright’s weekly assistance to remove litter and illegal dumps, helping prevent roadway dumping and enhance public safety.
