a. RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Chief Probation Officer to execute a Standard Agreement with Turning Point of Central California, Inc., to provide transitional housing services for adult offenders eligible for the AB 109 Public Safety Realignment plan, effective July 1, 2025 through June 30, 2026, not to exceed $930,029; and
b. Authorize the Chief Probation Officer to sign future amendments to the Agreement where the amendments do not exceed 10% ($93,002) of the original Agreement amount and do not significantly alter the scope of services, for a not to exceed maximum of $1,023,031.
SUMMARY:
California Assembly Bill 109 (AB 109), Public Safety Realignment Act of 2011, allocates funding to counties for the implementation of state-mandated local programs related to adult offenders that have been realigned from State to local jurisdictions. The Probation Department (Probation) serves as lead agency and fiscal agent for the implementation of the AB 109 Public Safety Realignment plan for Monterey County. Funding is allocated for custody, supervision, treatment, and transitional housing services. The Probation Department recommends entering into a Standard Agreement with Turning Point of Central California, Inc. (Turning Point) to provide transitional housing services for eligible adult offenders in fiscal year 2025-2026.
DISCUSSION:
AB 109 allocates funding to counties for state-mandated local programs related to adult offenders that have been realigned from the State to local jurisdictions. The Probation Department serves as lead agency and fiscal agent for the implementation of the AB 109 Public Safety Realignment plan; this plan includes funding for transitional housing services.
For fiscal year 2025-2026, AB 109 funding in the amount of $921,840 has been allocated to Turning Point to provide transitional housing services for adult offenders eligible for the program. Turning Point is a non-profit agency that provides a residential program, which offers housing with supervision and support services to up to thirty-two (32) male and female offenders for up to six (6) months. The proposed Standard Agreement will allow Turning Point to provide these services for fiscal year 2025-2026.
In addition to AB 109 funding, the State has allocated Juvenile Justice Realignment Block Grant funding (SB 823) to Probation to support costs and programs related to the impacts of the recent closure of Department of Juvenile Justice facilities. Services under the proposed Agreement with Turning Point will also be extended to SB 823 eligible participants. An estimated $8,189 in SB 823 funding will also be utilized on an as needed basis to reimburse Turning Point for services provided to qualifying clients recently released from one of Probation’s Juvenile Institutions.
OTHER AGENCY INVOLVEMENT:
The Standard Agreement has been approved by the Office of the County Counsel as to form and by the Auditor-Controller’s Office as to fiscal terms.
FINANCING:
FY 25-26 funding for these services is comprised from two State sources. The amount of $921,840 is provided by the State AB 109 Public Safety Realignment (AB109) allocation. The amount of $8,189 is provided by the State SB 823 (SB823) allocation. Locally, these amounts were approved for FY 25-26 distribution to Probation by the Community Corrections Partnership for the AB109 program on February 5, 2025 and by the Juvenile Justice Coordinating Council for the SB823 program on February 13, 2025. Subsequently, the total funding of $930,029 was included in Probation’s FY 25-26 Recommended Budget for budget units 001-2550-8165 and 001-2550-8163. There is no additional cost to the County General Fund associated with this recommendation.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommendation to approve the Standard Agreement with Turning Point supports key objectives of: 1) Economic Development by providing housing opportunities to improve the economic circumstances of the realigned population; 2) Health and Human Services by providing access to County services that improve quality of life and residential stability; and 3) Public Safety by assisting with self-sustainability to aid in crime prevention and successful reintegration into the community.
