Upon motion of Supervisor Parker, seconded by Supervisor Salinas, and carried by those
members present, the Board hereby:

RECOMMENDATION:
It is recommended that the Board of Supervisors:
A. Approve and authorize the Contracts/Purchasing Officer to execute separate Alternate
Defender Office Attorney Agreements with effective terms of July 1, 2009 to June 30, 2010 for
Steve D. Liner $138,000), Scott Erdbacher $138,000), Susan Chapman $138,000), Paddy L.
Grinstein $110,000) and Jeffrey Gobell $109,500);
B. Authorize the Contracts /Purchasing Officer to execute one year extensions to each of the
Agreements at the end of contract term for fiscal year 09-10, with otherwise identical terms and
conditions.
SUMMARY/DISCUSSION:
The Monterey County Alternate Defender Office finds it necessary to assign qualified trial
counsel for indigent defendants, parties, or juveniles in cases in which the Court finds that the
Public Defender has properly declared a conflict of interest. To accommodate these alternate
defense requirements, and to control costs for outside professional legal services, the County has
historically entered into contracts with private attorneys to accept appointments to represent
indigent parties.
The Alternate Defender Office is recommending that the Board enter into five separate contracts
for 2009-2010 fiscal year's professional legal conflict services, each with effective terms of July
1, 2009 through June 30, 2010 with: the Law Office of Steve D. Liner, the Law Office of Scott
Erdbacher, the Law Office of Susan Chapman, the Law Office of Jeffrey Gobell and the Law
Office of Paddy L. Grinstein. It is also recommended that the Contracts/Purchasing Officer be
authorized to negotiate and execute one year extensions to each of these Agreements with
otherwise identical terms and conditions.
These attorneys have each been performing these services for some time, in some cases for
years, and the Court and the Alternate Defender Office have been satisfied with their individual

OTHER AGENCY INVOLVEMENT:
The County Administrative Office has reviewed this report. County Risk Management has
reviewed and approved the Agreements' standard County insurance and liability terms.
FINANCING:
The annual compensation for each of the contracts is funded through the Public Defender
Alternate Defender Office. Funding for the Agreements is included in the FY 2009-10
Recommended Budget, Dept. 2270, Budget Unit 8168. Approval of the recommended actions
will have no additional impact on the County General Fund.
