RECOMMENDATION:
It is recommended that the Board of Supervisors:
Approve a three-year agreement with GEO Reentry Services, LLC, a wholly owned subsidiary of The GEO Group. Inc., not to exceed $958,125 annually, for a total of $2,874,375, to provide services to adult offenders participating in the Day Reporting Center for the period July 1, 2015 through June 30, 2018.
SUMMARY:
The Probation Department is recommending the approval of a multiyear agreement with GEO Reentry Services, LLC for continuation of a Day Reporting Center (DRC) for adult offenders in Monterey County.
DISCUSSION:
The Day Reporting Center model is recognized as an effective correctional strategy and community-based alternative to incarceration for eligible adult offenders. The program uses Motivational Interviewing techniques and a curricula-driven, evidence-based model designed to assess the criminogenic needs of each client to reduce individual risk factors, develop individual goals, and make positive life changes. Treatment and supervision services are provided in a one-stop setting for moderate and high-risk adult offenders.
The Day Reporting Center offers counseling, treatment, life skills classes and job training to eligible participants. The center is open seven days a week and has a capacity of up to 100 clients per day. These services fill a critical gap in the post-detention transition of adult offenders and provide needed rehabilitative services, which had been underfunded in the past.
Day Reporting Services for the Probation Department were solicited via a County Request for Proposal (RFP#10504) overseen by the Contracts/Purchasing Department. Four vendors responded to the RFP; the top two responders were interviewed by a panel that included representatives from the Probation Department, the Bureau of Behavioral Health, and the Parole Division of the California Department of Corrections and Rehabilitation. After completion of the RFP process, the Contracts/Purchasing Officer tentatively selected the organization that had been providing services to the County under a contract with B.I. Incorporated to provide DRC services in Monterey County. B.I. Incorporated had been acquired by The GEO Group, Inc. in 2011. Since 2011, The GEO Group has been realigning its various entities, and GEO Reentry Services, LLC, is the name of that part of the organization dealing with non-residential entry services, including the operation of day reporting centers. The GEO Group proposal was the lowest responsible bidder.
B.I. Incorporated has been providing these services since 2010, when the program was initiated with a two-year Recovery Act Edward Byrne Memorial Competitive grant from federal stimulus funding from the U.S. Department of Justice - Office of Justice Programs. After the termination of the grant, the program has been supported by AB 109 - Public Safety Realignment funding to continue services to realigned populations of adult offenders referred by the Probation Department. Probation also extended access to parolees referred and funded by the California Department of Corrections and Rehabilitation (CDCR) through a separate contract.
The proposed contract has been structured to address concerns expressed about program cost for actual utilization as well as management communication and continuity through contract negotiation for scope of services and vendor responsibilities. The cost structure allows paying for enrollment for a minimum of 50 clients daily and a tiered structure for economy of scale with expansion of services with increased enrollment. Based on past and present operations of the DRC, it is anticipated that at least 60 clients will use these services regularly. Responsibilities also include prompt and direct communication with Probation executives concerning staff changes that affect the program, particularly for leadership and management. In addition, the contract calls for monthly progress reports for each participant, so the Department can identify and act on any possible performance issues.
This Agreement contains the County's standard 30-day "no cause" provision, which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.
OTHER AGENCY INVOLVEMENT:
County Counsel, Auditor-Controller, and Risk Management have reviewed and approved this Agreement as to legal form, fiscal provisions, and insurance requirements. This Agreement is on file with Clerk of the Board.
The Community Corrections Partnership (CCP) has reviewed the contract and supports approval of the initial term.
FINANCING:
Reimbursement for services under this contract is funded from the Public Safety Realignment Act and State reimbursement. There is no anticipated increase in County General Fund Contribution with the current recommended action.
Cost for services is partially offset by a contract with the California Department of Corrections and Rehabilitation (CDCR) for a maximum of $324,000 per year as a reimbursement for services provided to parolees. These amounts are calculated on the basis of 30 parolee clients, at a daily cost of $30 per client, for an estimated 360 days per year, but are paid based on actual enrollment.
Funding for the maximum annual amount of $958,125 is calculated on a maximum of 90 clients daily, has been approved by the CCP for this program and has been included in Probation's Recommended Budget for FY 15-16.
The remaining funds for this Agreement, in the maximum amount of $958,125 for each of FY 16-17 and 17-18, will be included in the Probation Department Recommended Budget for those fiscal years.
