RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to sign a two (2) year agreement between the Sheriff’s Office and the Department of State Hospitals for an amount not to exceed $3,380,265.00, to host a regional Jail Based Competency Treatment program in the Monterey County Jail retroactive to July 1, 2021 with a term ending date of June 30, 2023; and

b. Authorize and direct the Auditor-Controller to amend the Sheriff’s Office FY 2021-22 Adopted Budget to increase appropriations by $79,387.00, in 001-SHE003-2300-8238-6610 financed by increased revenues of $79,387.00  in 001-SHE003-2300-8238-5050 (4/5 vote required).

 

SUMMARY/DISCUSSION:

On September 10, 2019, the Monterey County Board of Supervisors unanimously approved a contract between the Monterey County Sheriff’s Office and the Department of State Hospitals (DSH) to host a regional Jail Based Competency Treatment (JBCT) program aimed at restoring to competency those inmates charged with felonies and found by the courts to be incompetent to stand trial, with board order A-14494.

 

Due to the continued overwhelming need for beds and program space for inmates found by local Superior Courts to be incompetent to stand trial, DSH has requested that MCSO continue the program for at least another two (2) years. The program will continue to provide service to inmates in Santa Cruz and San Benito Counties as well. The program has proven to be effective in getting inmates into treatment and restored to competency.

 

The number of inmates in the Monterey County Jail, with mental health issues continues to grow. The JBCT has a set curriculum, established by the DSH, administered by CFMG. This curriculum includes classroom environment programming, counseling and a therapeutic living environment that fosters socialization with other program participants. Where necessary it would also include individual work with program participants. The program currently operates as a 10-bed program, however, in July 2022, the program will operate as a 11-bed program, meaning it could accommodate 11 inmates at any time.

 

The Sheriff’s Office had already included the JBCT program in the FY 2021-22 approved budget. MCSO spent several months working with DSH and the Department of Finance in an effort to increase the daily bed rate for the JBCT program. During the first two (2) years of the contract, DSH agreed to pay $419.25 per bed per day. After negotiation the approved daily rate of $441.00 per bed for 10 beds will require that an increase in Appropriations and Revenue amounting to $79,387.00 will need to be incorporated in the Sheriff’s budget. DSH will pay $441.00 per bed per day in the amount of $1,609,650.00 for FY 21-22 and $1,770,615.00 for FY 22-23 for a total amount of $3,380,265.00.

 

OTHER AGENCY INVOLVEMENT:

The Sheriff’s Office has consulted with the County Counsel’s Office and the County Administrative Office has reviewed this report and this request. Susan Chapman of the Public Defender’s Office and Kathryn Eckert Bureau Chief of Behavior Health support this agreement.

 

FINANCING:

On July 28, 2021, the Budget Committee unanimously supported the increase in revenues and appropriation. The funding for this agreement will be paid by the Department of State Hospitals. FY 21-22 $1,609,650.00, FY 22-23 $1,770,615.00, total $3,380,265.00, there will be no cost to the County General Fund.
