Title
a. Declaring an emergency as defined by the California Public Contract Code Section 1102 due to needed repair of the imaging equipment at Natividad Medical Center (NMC) Contractor - GE HealthCare; and
b. Finding that the emergency will not permit a delay resulting from a formal solicitation of bids and that the action is necessary to respond to the emergency; and
c. Finding that the repairs are necessary to permit the continued conduct of County operations or services; and
d. Authorizing emergency repair of the imaging equipment at NMC without adopting plans and specifications and giving notice for bids to let contracts; and
e. Authorizing the NMC Purchasing Manager, or his designee, to enter into contracts and issue purchase orders to accomplish the required emergency work, and ratifying the execution of emergency contracts and actions taken by the NMC Purchasing Manager, or his designee, to respond to the emergency. (4/5th vote required).

RECOMMENDATION:
It is recommended the Board of Supervisors adopt a resolution:

SUMMARY/DISCUSSION:
On October 29, 2012, the Diagnostic Imaging equipment needed a tube replacement. The Imaging equipment is needed to complete an x-ray on a patient. X-Ray images are vital to the treatment plan of a patient. The X-Ray Images that are produced provide diagnostic information to the care provider such as broken bones, pneumonia in the lungs, and other trauma to the skeletal system. The tube is the basic part in the equipment that provides the radiation dose which enables the equipment to take the picture. This piece of equipment is considered end of life by the GE HealthCare service team that provides repair services for the Diagnostic Imaging Department at Natividad Medical Center; therefore, this piece of equipment is not covered in the existing service contract to repair the equipment. GE HealthCare will still repair the equipment but it is billed as time and parts per incident. The total cost of this incident for repair was $12,985.13 which includes time and parts.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed and approved the procedures for finding the need for an emergency action and the emergency contract.
FINANCING:
The cost for the repair of the equipment including travel, labor, parts and tax was $12,985.13. These expenditures were fully funded by NMC, Fund 9600 unit 960. This action did not require any additional General Fund subsidy.
