RECOMMENDATION:
It is recommended that the Board of Supervisors:
1. Accept the Annual Progress Report for the 2010 General Plan implementation (Attachment A, Exhibits 1 & 2) pursuant to Government Code Section 65400;
2. Accept the Annual Housing Progress Report for the 2009-2014 Housing Element Implementation (Exhibit 3 of Attachment A) to comply with State Department of Housing and Community Development requirements;
3. Authorize the Resource Management Agency Director to submit the final progress reports to the State Office of Planning and Research and State Department of Housing and Community Development.
4. Accept the Resource Management Agency Long Range Work Program (Attachments B & C).
SUMMARY:
State law requires local agencies to submit an annual report on the status of the General Plan, including progress on implementing Housing Element objectives, any General Plan Amendments/Updates, and/or implementing ordinances completed. Major tasks completed during calendar year 2015 include:
• Design Guidelines for Exterior Lighting (Ordinance and Guidelines adopted: January 26, 2016)
• 2015-2023 Housing Element Update (Adopted: January 26, 2016)
• Tracking System/Reporting (Status Report Received: October 28, 2015)
• Agricultural Wine Corridor Plan/Reporting (Status Report Received: October 28, 2015)
• Carmel Valley Unit Count (Status Report Received: October 28, 2015)
• Capital Improvement Program (CIP) & Amendment -(Adopted: May 27, 2015& July 8, 2015)
• Cultural Resource Protection Guidelines (Ordinance adopted: April 28, 2015)
• Cultural Resource Design and Report Criteria (Adopted: April 28, 2015)
• Establish a Native American Panel (Adopted: April 28, 2015)
• Salinas Valley Zone 2C - Salinas River Ground Water Basin - State of the Salinas River Groundwater Basin Report (Receive Report: December 16, 2014)
Staff has prepared the annual reports for Board consideration. In addition, staff is providing the Board with an updated comprehensive summary matrix on the long range work program tasks of the Resource Management Agency (RMA). This Work Program was initiated with the adoption of the 2010 General Plan and has been expanded to include tasks associated with new state laws, board referrals and other policy issues that arise. Resource Management Agency has assumed the lead working with all County land use agencies as well as the Monterey County Water Resources Agency.
Attachment A is the annual report of the 2010 General Plan Implementation Plan. Exhibits 1 and 2 of the annual report identify the status and next steps of the task for the upcoming year specific to general plan implementation. Attachments B & C expands Exhibits 1 and 2 to include the whole RMA work program, including Board referrals. This is an opportunity for the Board of Supervisors to review staff’s progress and provide direction on setting priorities.
DISCUSSION:
Government Code Section 65400 (a)(2) requires cities and counties to provide an annual report to the legislative body regarding the status of the General Plan and progress in its implementation and the degree to which the General Plan is consistent with the General Plan Guidelines adopted by the Governor’s Office of Planning and Research (OPR). The housing element portion of the report must conform to specific content requirements, and the reports must be submitted to OPR and HCD in April of each year. Resource Management Agency is lead for preparing the Annual Progress Report for the County’s 2010 General Plan Implementation (GPI) with assistance from the Economic Development Department for preparing the Annual Progress Report for the 2009-2014 Housing Element Implementation (HEI).
When the 2010 General Plan was adopted, staff identified over 100 tasks to implement that Plan. Since the adoption of the RMA Long Range Work Program (LRWP), 42 General Plan tasks have been completed. This report presents to the Board a status of the implementation of the 2010 General Plan tasks and implementing housing programs. The comprehensive RMA LRWP (Attachment B) includes tasks related to General Plan Implementation, Board of Supervisors’ and Planning Referrals, changes in state or federal law, and Local Coastal Program Updates. Over this past year (2015) staff has conducted multiple meetings with stakeholders and based on comments received regarding the difficulty of following the implementation of the General Plan, for this report, staff has separated the General Plan Implementation tasks from the comprehensive LRWP Summary Matrix so that the public can easily track our progress on the implementation of the General Plan. Additionally staff has divided the completed tasks between tasks for which an ordinance/program has been adopted and tasks where reports are required to be presented either annually or at a specified yearly interval (categorized as: “Annual & Internal Reports Required”).
A total of 45 General Plan tasks have been in process during the 2015 calendar year: 10 to completion; 13 to the Board of Supervisors; 4 to the Planning Commission as either a hearing or workshop; 4 Under Preparation & Public Outreach, 8 in Internal Development and 6 Unassigned (not counted in the total in processed). Attachment A, Exhibits 1 and 2 provides the complete LRWP matrix. The following list summarizes the status of specific tasks:

Pursuant to Government Section 65400, Attachment A, Exhibit 2 provides a detailed account of the County’s progress on meeting it share of the regional housing needs.
CEQA:
The recommended progress reports are not projects as defined by the California Environmental Quality Act (CEQA), Guidelines Sections 15060(c) (3) and 15378. These reports are an administrative activity that will not result in direct or indirect physical changes to the environment. They are for information purposes only. Activities identified in these reports implement policies of the 2010 General Plan and the 2009 Housing Element, which were subject to CEQA review.
OTHER AGENCY INVOLVEMENT:
Implementation of the 2010 General Plan involves close coordination between all of the land use departments/agencies (Planning, Public Works, Environmental Services, Environmental Health, and Water Resources Agency). Implementation of the Housing Element relates to activities being undertaken by both the Economic Development Department (Housing Office) and RMA-Planning. In addition, the County Counsel’s office is actively participating in the legal review of ordinances and plans being prepared as part of General Plan implementation and other needed updates.
FINANCING:
These annual reports are prepared by staff and have no impact to the County General Fund. Much of the implementation work is performed by staff, with no additional cost to the General Fund. However, there are aspects of the work that require technical expertise that is only available through outside consultants.
On June 23, 2015, the Board approved one-time funding of $1,000,000 to offset FY 2015 -2016 expenditures related to technical support for General Plan Implementation, Carmel River Lagoon, Local Coastal Plan update and the Salinas Valley Ground Water Basin Study.
On March 8, 2016 the RMA requested as an augmentation request to its FY 2016-17 Baseline Budget for the continuation of one-time funding in the amount of $1.7M to fund outside consultants expertise required for the on-going work related to the implementation of the General Plan, Carmel River Lagoon, Local Coastal Plan update and the Salinas Valley Ground Water Basin Study. In the meantime, staff continues to seek grant funding, where available, to help with implementation and LCP update efforts.
