RECOMMENDATION:
It is recommended that the Board of Supervisors:
Adopt resolution finding that a public convenience would be served by the issuance of a Type 20 (Off-Sale Beer and Wine) license by the Department of Alcoholic Beverage Control (ABC) to Rideout Big Sur Properties, LLC. (a.k.a. Riverside Campground and Cabins) at 47020 Highway 1, Big Sur, CA 93920 for the sale of beer and wine for the guests of the campground.   
 
SUMMARY:
Riverside Campground & Cabins (also known as Big Sur Properties LLC) located at 47020 Highway 1, Big Sur, has been in operation since the 1960's providing guests with campground, cabins and a campground store.  The applicant is requesting a Type 20 Alcoholic Beverage Control (ABC) license which would permit the sale of beer and wine from the existing campground store.  Sales would be directed primarily to their guests.  
 
Section 23958.4 of the California Business and Professional Code requires that a finding of "Public Convenience or Necessity" be made by the appropriate local jurisdiction before the California Department of Alcoholic Beverage Control may issue a Type 20 license.  ABC looks at population and the number of licenses, each by census tract.  They assume a certain number of licenses are needed per population.  This census tract is considered to have an "undue concentration" of licenses, as it has 7 (Type 20) active licenses where only 2 would be normal for the population within this tract.  One of the factors considered are crime rates and public safety.  Staff supports approval of the finding for "Public Convenience and Necessity" for the following reasons:  
 
1)       Staff has conferred with the Monterey County Sheriff's office and the Sheriff does not object to the issuance of a Type 20 (Off-Sale Beer and Wine) license;
2)       Calls for police service at this location are extremely low;
3)       Off-sale beer and wine would be directed primarily to their guests;
4)       The campground has an existing 10:00 p.m. to 8:00 a.m. quiet time at the premises; and
5)       Applicant resides on site and employs a night time manager.  Campground staff is also on call 24 hours if needed.
 
OTHER AGENCY INVOLVEMENT:
The request was referred to the Sheriff's Office who did not oppose the granting of the Type 20 (Off-Sale Beer and Wine) license.  See Exhibit B.  
 
 
 
FINANCING:
Funding for staff time associated with this project is included in the FY11-12 Final Budget for the Planning Department.
