RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and authorize the Director of Health or Assistant Director of Health to sign an Agreement with Stericycle, Inc., for hazardous medical waste retrieval and disposal services for the term July 1, 2018 to June 30, 2020 and a contract amount not to exceed of $55,000; and

b.                     Approve the recommendation of the Director of Health to accept the following non-standard risk provision: lowered limits for following insurance coverage applicable to small quantity hazardous waste producer (general liability insurance, pollution legal liability coverage, automobile liability coverage, and worker’s compensation-no blanket crime coverage); and

c.                     Authorize the Director of Health, or Assistant Director of Health to sign up to three (3) future amendments to this Agreement where the amendments do not exceed 10% of the original contract amount ($5,500), and do not significantly change the scope of work.

 

SUMMARY/DISCUSSION:

The Health Department Clinic Services Bureau (Health Department) operates nine community clinic sites designated as Federally Qualified Health Center Look-Alikes (FQHC-LA), which provide preventative, primary, and specialty medical care services. 

 

Medical waste retrieval and disposal services are required by various regulating agencies, including Occupational Safety and Health Administration (OSHA), per waste segregation requirements as defined by the Environmental Protection Agency (EPA). 

 

Clinic Services has contracted with Stericycle since 2011 to comply with medical waste regulation agencies through the proper pickup, treatment, and disposal of biohazardous and pharmaceutical waste services, and they have demonstrated that they are reliable and have capacity and flexibility to meet the expanding needs of the Clinics. The Health Department is requesting insurance modifications to the County standard because all Health Department clinic sites are registered as “Small Quantity Waste” generators as defined by the EPA due to the low volume of medical waste generated monthly per each site.  This in comparison to “Large Quantity Waste” generators such as hospitals or large in-patient facilities, means that the Health Department clinics have less strict reporting and regulation standards. Approval of the recommended action will maintain compliance with regulating agencies while providing essential waste removal and disposal services.

 

This work supports the Monterey County Health Department 2011 - 2015 Strategic Plan initiative: 2) Enhance community health and safety by emphasizing prevention.  It also supports one or more of the ten essential public health services, specifically: 6) Enforce laws and regulations that protect health and ensure safety.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed and approved the Agreement as to form. Auditor-Controller and Contracts/Purchasing have reviewed and approved the Agreement.  Risk Management has reviewed and requests Board approval of the non-standard insurance provisions, based on the vendor’s position that lower insurance limits are applicable here, where the vendor deems it is a small hazardous waste generator for purposes of this Agreement. Clinic Services recommends moving forward with this Agreement to maintain compliance with both state and federal medical waste regulations.

 

FINANCING:

Sufficient funds are available in the FY 2018-2019 Recommended Budgets for both Clinic Services Bureau, Health Department (4000-HEA007) and Public Health (4000-HEA003).  There is no financial impact to the General Fund resulting from approval of this Agreement.
