RECOMMENDATION:
Approve and authorize the County Clerk/Recorder (CCR) to execute Amendment No. 1 to the Agreement (A-16002) with BMI Imaging Systems, Inc. (BMI), to provide a Digital Reel System Upgrade, for the term beginning September 1, 2022, through June 30, 2024, and adding $3,600 for a revised total agreement amount of not to exceed $51,320.
SUMMARY/DISCUSSION:
Currently, the Recorder’s office utilizes Digital Reel for the hosting of real property documents from 1850 to 1977 for business purposes and customer viewing in the lobby. On September 28, 2021, the Governor approved Assembly Bill No. 1466 regarding real property discriminatory restrictions. Beginning July 1, 2022, as per Government Code 12956.3, the County Recorder’s office “shall establish a restrictive covenant program to assist in the redaction of unlawfully restrictive covenants in violation of subdivision (I) of Section 12955.” The Recorder’s office is asking for the Board’s approval to move forward with BMI in compliance with said statute.
The term of the maintenance and support services as identified in the attached Exhibit A shall be for September 1, 2022 through June 30, 2024. The total financial liability to the County for September 1, 2022 to June 30, 2024 pursuant to the terms of this Amendment No. 1 shall not exceed $51,320. Board approval will facilitate the seamless provision of these services provided by the vendor. The total aggregate contract amount shall not exceed $51,320.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed Amendment No. 1 and has approved as to form.
FINANCING:
Funds for payment of this Amendment No. 1 are available in the County Clerk/Recorder’s Modernization Fund (027-2730-ACR003).
There is no additional financial impact to the County General Fund.

The services rendered in this agreement provide the CCR with the additional support it needs to
provide reliable and high-quality services to the residents of Monterey County.
