b. Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 2 to Professional Services Agreement No. A-15826 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 2 to Professional Services Agreement No. A-15826, Multi-Year Agreement #3200*6415, with Biggs Cardosa Associates, Inc. to provide construction management services for the Hartnell Road Bridge Replacement Project, County Bridge No. 209, Request for Proposals #10804, to increase the not to exceed amount by $199,698 for a total amount not to exceed $880,172 with no extension to the term from June 15, 2022 to June 14, 2025, with the option to extend the term for two additional 1-year period(s); and
b. Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 2 to Professional Services Agreement No. A-15826 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.
SUMMARY/DISCUSSION:
The County of Monterey Department of Public Works, Facilities and Parks (PWFP) is replacing the existing two-lane Hartnell Road Bridge (County Bridge No. 209) over Alisal Creek in Monterey County, California, with a wider bridge, Hartnell Road Bridge Replacement (Project), that meets current American Association of State Highway and Transportation Officials (AASHTO) requirements. The Project also widens the roadway approaches for approximately 370 to 470 feet on the north and south ends of the bridge to conform to the replacement bridge width and profile. After construction, both the bridge and roadway approaches would contain two 12-foot lanes with one in each direction and two 8-foot shoulders and meet current AASHTO minimum speed standards.
Biggs Cardosa Associates, Inc. (BCA) was selected for their expertise and capabilities necessary to provide construction management services for the Project under a competitive selection process in accordance with County policies and State and Federal laws under Request for Proposals (RFP) #10804. On June 7, 2022, the Board of Supervisors approved Professional Services Agreement (PSA) No. A-15826 with BCA in the amount of $393,328 to provide construction management services for the Project for a term through June 14, 2025. On April 18, 2023, the Board of Supervisors approved Amendment No. 1 to PSA No. A-15826 to increase the not to exceed amount by $287,146 for a total amount not to exceed $680,474.
Completion of the Project was delayed due to damage caused by the 2023 winter storms which required implementing emergency channel protection, coordinating and managing the required permit extensions, obtaining permit updates, and designing permanent repair improvements, and managing construction of the emergency measures and permanent repair improvements. Due to the additional services needed to complete the repairs, (including project close-out), the previously anticipated Project completion date has been extended. Amendment No. 2 will allow for additional construction management services for the emergency repairs and Project completion.
PWFP staff recommends that the Monterey County Board of Supervisors approve Amendment No. 2 (Attachment A) to the PSA with BCA to continue to allow construction management services for the Project. Amendment No. 2 will increase the not to exceed amount of $680,474 by $199,698 for a total amount not to exceed $880,172 with no extension to the term ending on June 14, 2025.

OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 2 as to form, and fiscal provisions, respectively.
FINANCING:
The total estimated cost of the Project including design engineering, environmental, right-of-way, and construction is $6,382,696.
The Project is largely funded by the Federal Highway Administration (FHWA) Highway Bridge Replacement and Rehabilitation (HBRR) Program in the amount of $3,351,476. The Federal funds require an 11.47% local match that will be provided by the State Toll Credits fund in the amount of $421,197. Local Measure X funds in the amount of $349,692 will also be provided. Additional funds are pending from the FHWA HBRR Program with a local State match in the amount of $2.260,331. See Attachment D for further details on the Project budget. There are sufficient appropriations in the adopted fiscal year (FY) 2023-24 Road Fund 002, Appropriation Unit PFP004 budget to finance Amendment No. 2 for the construction phase of the Project.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors’ Strategic Initiatives for Infrastructure and Public Safety. The Project consists of replacing the existing Hartnell Road Bridge that is structurally deficient and functionally obsolete with a new two-lane bridge that meets current State standards, including geometric and seismic standards.
