RECOMMENDATION:
It is recommended that the Board of Supervisors:
Approve and authorize the Chief Information Officer of the Information Technology Department to sign and execute Amendment No. 1 to the Memorandum of Understanding with the Monterey-Salinas Transit District, providing for communications vault space and supporting services at the Williams Hill Site operated by the County, retroactive to December 1, 2023, through November 30, 2028.
SUMMARY:
Monterey-Salinas Transit District (MSTD) has subleased rack space located at the Williams Hill Site from the County since December 2018. This site provides critical communications support to the County, and private and public agencies located on the Monterey Peninsula. MSTD and the County wish to extend the term of the Memorandum of Understanding.
DISCUSSION:
The Information Technology Department’s (ITD) Infrastructure team manages and maintains County radio communications sites used to operate radio equipment and other public safety and emergency devices throughout the County. County radio communications sites are located throughout the County on County owned real property, on leased land where the County owns an equipment shelter and/or tower, or as a lessee for non-County sites where ITD leases shelter and tower space. MSTD has subleased with ITD where the County is prime lessee for tower and rack space within the State of California Department of General Services at the Calandra LO site located on Williams Hill.
This site hosts digital two-way radio and wireless microwave backhaul infrastructure to provide enhanced and reliable public safety communications for south Monterey County near the Nacimiento and San Antonio Lake areas.
In 2015, the Board approved a lease template that ITD created to facilitate the lease process for all agencies approved to install equipment at County communication sites in the future. The lease template provides for an annual rental charge that recoups the cost of providing rack space and associated communications services utilized by the entities on the site.
MSTD and the County wish to amend the lease by extending the term through 2028 with the same terms as the current lease. However, due to MSTD’s request to renegotiate the indemnification language the agreement lapsed. MSTD has agreed to maintain the original terms of the lease without any modifications.
The Chief Information Officer recommends the renewal of this retroactive lease extending the term through November 30, 2028, on the same similar terms to the current lease.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed and approved this amendment.
FINANCING:
Approval of this lease will have no impact on the general fund as this is a revenue generating agreement.
