b. Authorize the Chair of the Board to execute the Road Maintenance Agreement.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
 
a.      Approve a Road Maintenance Agreement, between the County of Monterey and Telespan Communications, LLC, in compliance with Combined Development Permit (PLN120802), 0.5 mile south of the Hall Road and San Miguel Canyon Intersection, North County Land Use Plan and;
 
b.      Authorize the Chair of the Board to execute the Road Maintenance Agreement.
 
SUMMARY/DISCUSSION:
On January 29th, 2014, the Planning Commission of Monterey County approved Use Permit PLN120802 for Telespan Communications, LLC, to allow the development of a wireless telecommunications "Co-location Facility."  To access the project's site, the applicant will build a new access road.  The proposed access road alignment will cross over County Right-of-Way. To specify maintenance and liability responsibilities, the following Condition of Approval was placed on the project: Road Maintenance Agreement (Condition No. 21).  
 
Condition No. 21 requires the applicant to enter into a Road Maintenance Agreement with the County for maintenance and liability of the entire access road from San Miguel Canyon to the cell site.
 
The agreement requires the applicant to maintain the access road in combination with the development of the permitted project, satisfying Condition 21.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Risk Management have reviewed and approved the Road Maintenance Agreement as to form.
 
FINANCING:
There is no financial impact to the General Fund.  This agreement allows TeleSpan to maintain their access road that is located in the County right-of-way.
