b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 5 to Professional Services Agreement No. A-11031 and future amendments to this Agreement where the amendment does not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 5 to Professional Services Agreement No. A-11031 with TRC Engineers, Inc. to include Phase II, Final Design Tasks, for the Davis Road Bridge Replacement and Road Widening Project, located in Salinas, Ca., County Bridge No. 208, State No. 44C068, Project No. 360065, Federal Aid Project No. BRLO-5944 (086), in the amount of $3,899,368 for a total amount not to exceed $4,459,731, and extend the term to December 31, 2021; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 5 to Professional Services Agreement No. A-11031 and future amendments to this Agreement where the amendment does not significantly alter the scope of work or change the approved Agreement amount.
SUMMARY/DISCUSSION:
On October 9, 2007, the Board of Supervisors approved Professional Services Agreement (PSA) No. A-11031 with TRC Engineers, Inc. (TRC) in the amount of $396,850 to provide structural engineering services for the Davis Road Bridge Replacement and Road Widening Project located in Salinas, Ca., County Bridge No. 208, including the widening of Davis Road to four lanes between Blanco Road and Reservation Road, Project No. 360065, Federal Aid Project No. BRLS-5944 (086), for a term to January 17, 2010. The project proposes to replace the existing bridge on Davis Road over the Salinas River between Reservation Road and Foster Road, and construct in its place a 1700-ft, all-weather bridge that meets current flood protection design requirements that can accommodate the high flows of the Salinas River. The County also proposes to widen Davis Road between Reservation Road and Blanco Road to four travel lanes, with associated intersection improvements at Hitchcock Road, Foster Road, and Reservation Road.
Following several iterations of the bridge concept design and hydrology mapping of the Salinas River in the project vicinity, TRC has completed Phase I, Preliminary Engineering, of the project. Three (3) term extensions and one (1) budget contract amendment were necessary for completion of Phase I.
Completion of Phase I was necessary to accurately scope the final design tasks. Amendment No. 5 to the PSA authorizes Phase II, Final Design Tasks, for the project, increases the PSA by $3,899,368 for a total amount not to exceed $4,459,731, and will extend the term to December 31, 2021.
Attachment A provides a summary of the PSA to date.
OTHER AGENCY INVOLVEMENT:
The Offices of the County Counsel, Auditor-Controller, and Risk Management have reviewed and approved Amendment No. 5 as to form and legality, fiscal and indemnity and insurance provisions, respectively. Due to the significant scope of work and associated dollar amount increase for Phase II of the project, the Department of Transportation (Caltrans) required a pre-award audit for Amendment No. 5. Caltrans performed their review and provided a Conformance Review letter to the County on March 25, 2015.
FINANCING:
There is no impact to the General Fund. Sufficient appropriations of $1,478,465 are available for this project in the RMA-Public Works FY 2015-16 Budget for Fund 002, Unit 8195 RMA012, in which $600,000 is identified towards this PSA.
The estimated total cost of the project, including engineering, environmental, right-of-way and construction, is $59,028,267 and is expected to be completed in FY 2021. Funding from a variety of Federal (HBP and Toll Credits), State (STIP and RSTP), and Local revenue (FORA development mitigation impact fees and East Garrison development off-site mitigation impact fees) in the amount of $54,394,819 have been authorized for design, environmental review, right-of-way and construction of the project, as outlined in the attached Project Budget sheet. Additional funding in the amount of $4,633,448 remains unfunded for construction.
Staff will be performing a value engineering analysis as part of the proposed contract amendment to try to close the funding gap as well as coordinating with funding agencies to augment the available project funds.
