RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
 
a. Approve Amendment No. 3 to Agreement with Disaster Kleenup Specialists for Goods and/or Services Involving Hazardous Materials to increase the amount by $80,000, for a total amount not to exceed $180,000 for preventive maintenance and on-call services at county-wide facilities; and
 
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 3 to Agreement with Disaster Kleenup Specialists for Goods and/or Services Involving Hazardous Materials.
 
SUMMARY/DISCUSSION:
The proposed actions allow for an increase to the existing Agreement for Goods and/or Services Involving Hazardous Materials with Disaster Kleenup Specialists (DKS) from $100,000 to $180,000, for emergency building services and hazardous material abatement, including lead paint, mold, sewage, and asbestos, and remediation services within County facilities.
 
In July 2011, the Contracts/Purchasing Officer executed an Agreement for Goods and/or Services Involving Hazardous Materials with DKS, in the amount of $50,000, to provide Fire clean up, Water extraction and mitigation, Mold abatement, Sewage abatement/clean up, Asbestos abatement/clean up, Lead Abatement, Hazmat clean up, Hazardous /waste hauling, Contents restoration and Trauma/blood borne pathogen clean up (Agreement).
 
On April 9, 2012, Amendment No. 1 to the Agreement was executed increasing the Agreement amount to $80,000.  On May 14, 2013, Amendment No. 2 to the Agreement was executed increasing the Agreement amount to $100,000, and extending the term of the Agreement to June 30, 2014.  The County has incurred $14,265.89 in costs exceeding the authorized amount for Amendment No. 2.  Amendment No. 3 will increase the Agreement to $180,000 of which $14,265.89 will be paid, leaving a balance of $65,734.11 available through June 30, 2014.
 
Emergency building services are precipitated by unanticipated events, such as floods, fire, or concealed damage.  Abatement services are required for proper treatment of mold, asbestos, and lead paint encountered in the course of repairs and maintenance to County facilities.  The value of scheduled and unscheduled work against the Agreement recently exceeded $100,000 due to an emergency service required in the Public Safety Building to address a pressurized water line failure inside a wall separating the locker room and shower area.  Department of Public Works' Facilities staff investigated the incident and discovered extensive water damage inside walls and beneath floor surfaces.  To avoid further damage and a possible mold outbreak, DKS was called to provide treatment, which included containment, water extraction, demolition, and restoration of finished surfaces.  Timely containment and correction of the situation was paramount to restore access to the locker room facility used daily by Sheriff Deputies.  DKS' remediation charges for this work totaled $19,971.46, resulting in an aggregate expenditure total exceeding their $100,000 Agreement amount.  
 
As time is of the essence in responding to emergencies, there is an ever present need for on-call emergency building services and hazardous material abatement.  The recommended action will address anticipated need for the term of the Agreement.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller have reviewed and approved Amendment No. 3 to the Agreement as to form and legality and fiscal terms, respectively.  The proposed action was presented to the Budget Committee on June 12, 2013.
 
FINANCING:
Expenditures against the Agreement will be generated by the Facilities Division of Public Works, and charged to Fund 001, Unit 8176, operating budget for repair and maintenance, and if needed, Fund 401, Unit 8184, Unscheduled Projects for remediation services to cover costs incurred in current fiscal year and emergencies in FY 2013-14.  Operations and maintenance will be funded with the RMA-Public Works Facilities' annual operating budgets.
