RECOMMENDATION:
It is recommended that the Board of Supervisors:
Approve and authorize the Director of Health or designee to sign and record a deed restriction for alternative Onsite Wastewater Treatment System requirements, with Rancho Cielo, Inc. for permit number PLN110485 on County-owned property.  
 
SUMMARY/DISCUSSION:
On September 28, 2011, the Planning Commission granted Combined Development Permit No. PLN110485 for Assessor's Parcel No. 211-031-004-000 and 211-031-021-000, located at 710 Old Natividad Road, Salinas, California, owned by County of Monterey and leased by Rancho Cielo, Inc.  
 
Granting of this permit was subject to certain terms and conditions, including, but not limited to, the Environmental Health Bureau Condition 21, EHSP06, Alternative Onsite Wastewater Treatment System (OWTS).  Condition 21 states that the applicant shall record a deed restriction which indicates that an Alternative Onsite Wastewater Treatment System is installed on the property and specifies that:
·      A certified wastewater treatment plant operator shall be required to oversee the operation of the Alternative OWTS for the life of the system.
·      The Alternative OWTS shall be operated according to the manufacturer's or engineer's specifications.
·      The property will be subject to future federal, state or local laws and ordinances regarding the permitting, operation and maintenance of Alternative OWTS.  
 
On November 5, 2014, a request to record a deed restriction meeting these conditions was presented to the Environmental Health Bureau for signature and recording.  Because the County owns the property, the Director of Health requests approval and authorization to sign and record the requested deed restriction on behalf of the County of Monterey.  
 
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed the deed restriction as to form.
 
FINANCING:
Approval and authorization of this request will have no financial impact on the General Fund.
