a. Approve and authorize the Public Defender to execute an Agreement with the University Corporation at Monterey Bay, retroactive to October 3, 2024, for the provision of evaluation services for the 45-month Proposition 47 Cohort IV grant for a total not-to-exceed amount of $750,000 and a term of October 3, 2024, to June 30, 2028; and
b. Authorize the Public Defender or designee to execute up to three (3) future amendments to this Agreement that do not alter the not-to-exceed of $750,000 and do not significantly alter the scope of work.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Public Defender to execute an Agreement with the University Corporation at Monterey Bay, retroactive to October 3, 2024, for the provision of evaluation services for the 45-month Proposition 47 Cohort IV grant for a total not-to-exceed amount of $750,000 and a term of October 3, 2024, to June 30, 2028; and
b. Authorize the Public Defender or designee to execute up to three (3) future amendments to this Agreement that do not alter the not-to-exceed of $750,000 and do not significantly alter the scope of work.
SUMMARY/DISCUSSION:
On November 12, 2024, per Board Order No. A-17152, the County of Monterey Board of Supervisors authorized the Office of the Public Defender to accept an $8,000,000 Proposition 47 Cohort IV Grant (Prop. 47) award from the Board of State and Community Corrections (BSCC) and authorized execution of the associated grant agreement to fund mental health services, substance use disorder services, housing related assistance, community-based supportive services, and additional prevention/early intervention diversion services to Prop. 47 eligible adults and juveniles.
The Prop. 47 grant mandates significant data collection, reporting, and evaluation efforts, and encourages the use of outside evaluators-specifically institutions of higher learning-to ensure objective and impartial evaluations. The University Corporation at Monterey Bay (hereafter, University) conducts community research that facilitates the development of collaborative partnerships to improve health, human services, and public policy initiatives throughout Monterey County. The University has a proven track record as the lead evaluator for Prop. 47 grant-funded services in Monterey County, having served in this role for all three previously awarded Prop. 47 funding rounds. Their continued partnership ensures consistent Prop. 47 data collection, reporting, and evaluation.
Due to prolonged delays from the BSCC in issuance of the Prop. 47 grant funding agreement and prolonged contract negotiations with the University, implementation of this Agreement has been delayed. As such, the Office of the Public Defender and the University mutually desire to retroactively instate this Agreement to October 3, 2024, ensuring compliance with Prop. 47 grant evaluation and monitoring requirements. The University has consistently delivered services and fulfilled key grant requirements since October 3, 2024, completing critical deliverables in good faith.
OTHER AGENCY INVOLVEMENT:
County Counsel and the Auditor-Controller’s Office have reviewed and approved as to form.
FINANCING:
There will be no impact to the General Fund from this action. This Agreement is funded by Proposition 47 Cohort IV Grant funding. The Proposition 47 Cohort IV Grant does not require matching funds.
