RECOMMENDATION:

It is recommended that the Board of Supervisors:

Authorize the County Counsel to execute an Amendment No. 4 to the Agreement for Specialized Attorney Services ("Agreement") with Pillsbury Winthrop Shaw Pittman LLP, for the provision of employment tax legal services, extending the term an additional one (1) year, for a revised full term of May 15, 2021 through June 30, 2026, adjusting rates retroactively effective January 1, 2025, with no change to the total amount not to exceed of $75,000.

SUMMARY/DISCUSSION:

Pillsbury Winthrop Shaw Pittman LLP advises public agencies on compensation and benefits matters, including all issues relating to the design and administration of their retirement plans, health and welfare plans, and nonqualified benefit programs. The Pillsbury team also counsels governmental entities on the fiduciary responsibilities relating to their benefit programs, requirements of the federal and state laws governing benefit plans (including the Internal Revenue Code and California vested rights laws); and all operational issues confronting an agency’s benefit programs. The firm regularly advises governmental employers on federal, state and local payroll tax-reporting-and-withholding requirements.

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed and approved this amendment as to legal form.  Auditor-Controller has reviewed and approved this amendment as to financial provisions.

FINANCING:

There is no additional cost associated with this amendment. There is no impact to the General Fund.
