RECOMMENDATION:

It is recommended that the Board of  Supervisors approve and authorize the County Purchasing Agent or designee to execute Amendment No. 2 to the Agreement with ARC Alternatives, for provision of continued energy analytics and consulting services, extending the term through to June 30, 2027, for a revised term of October 1, 2022 through June 30, 2027 revising Exhibit A-1, and increasing the contract amount by $177,060 for a revised contract maximum of $545,660.

 

SUMMARY/DISCUSSION:

The County of Monterey entered into  an agreement with ARC Alternatives to provide energy analytics and sustainability consulting services to support the County’s long-term decarbonization and energy planning initiatives. The original agreement was effective October 1, 2022, through July 31, 2024, with a not-to-exceed amount of $160,000.

 

In March 2025, the Board approved Renewal and Amendment No. 1, which revised Exhibit A-1, extended the agreement term through July 31, 2026, and increased the contract by $208,600, establishing a revised not-to-exceed amount of $368,600. Board direction further authorized staff to execute up to three future amendments, provided that such amendments did not: 1) materially change contractor responsibilities, 2) increase the contract by more than 10% ($36,860), and 3) increase the total not-to-exceed amount beyond $405,460.  Amendment No. 2 proposes to further extend the agreement through June 30, 2027, and revise Exhibit A-1 to expand consulting services to include renewable energy credit registration, submetering, LCFS research, grid support program evaluation, EV infrastructure support, financial analysis, decarbonization planning, and on-call technical assistance in support of County and NMC sustainability and decarbonization initiatives.  Amendment No. 2 also increases the contract by $177,060, resulting in a new not-to-exceed total of $545,660.

 

Because the proposed amendment exceeds the maximum contract amount previously authorized under the Board’s delegated authority, Board approval is required.

 

 

OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:

The Office of the County Counsel has reviewed and approved the proposed amendment as to form.

 

FINANCING:

Approval of Amendment No. 2  will increase the contract by $177,060 for a total not-to-exceed contract maximum of $545,660. Funding is included in the FY 2025-26 adopted budget and FY 2026-27 Recommended budget, and has no budgetary impact at this time.
