RECOMMENDATION:

It is recommended that the Board of Supervisors:

Approve and authorize the Emergency Medical Services (EMS) Agency Director, the Director of Health, or the Assistant Director of Health, to execute Amendment No. 3 to extend the Paramedic Service Provider Agreement with Monterey County Regional Fire District on the same terms and conditions to January 31, 2020.

 

SUMMARY:

The Health Department seeks authorization to execute Amendment No. 3 to extend the Paramedic Service Provider Agreement with Monterey County Regional Fire District on the same terms and conditions to January 31, 2020.

 

DISCUSSION:

The Emergency Medical Services (EMS) Agency is designated under California law by Monterey County as the local Emergency Medical Services Agency responsible for planning, implementing, and evaluating the local EMS system throughout Monterey County.  Under California law, no person or organization may provide “advanced life support,” also known as “paramedic services,” unless that person or organization is an authorized part of the emergency medical service system of the local EMS agency.

 

Accordingly, under California law, a paramedic service provider must have a written agreement with the local EMS agency to participate in the EMS system and to comply with all applicable state regulations and local policies and procedures, including participation in the local EMS agency’s Continuous Quality Improvement (“CQI”) program.

 

The original Paramedic Service Provider Agreement was reviewed and approved by the Emergency Medical Care Committee (EMCC) on September 14, 2011 and by the Monterey County Board of Supervisors on November 1, 2011.  The Paramedic Service Provider Agreement with Monterey County Regional Fire District was executed on March 28, 2012 for a period of four (4) years. 

 

On March 7, 2017, the Monterey County Board of Supervisors approved and authorized the EMS Agency Director to execute an amendment to extend this Paramedic Service Provider Agreement retroactive to March 28, 2016 up through June 30, 2017 (Agreement to Retroactively Renew Agreement) to allow time to review and, if needed, revise the agreement to reflect the landscape of our current EMS system.  On June 27, 2017, the Board approved and authorized the EMS Agency Director to execute Amendment No. 2 to extend this Paramedic Service Provider Agreement for another year through June 30, 2018.

 

Monterey County Regional Fire District asserts it has status as California Health and Safety Code Section1797.201 jurisdiction; meaning that it is not required to have a paramedic service provide agreement to provide paramedic services, if it maintains its 1797.201 status.  The EMS Agency believes it is more desirable to have a limited medical control agreement rather than not having an agreement.  Therefore, parties wish to amend the Paramedic Service Provider Agreement to extend it through January 31, 2020 to coincide with the termination of the current ambulance agreement.

 

This work is not directly in support of a Health Department strategic initiative, it is in support of one or more of the ten essential public health services, specifically: 7) Link people to needed personal health services and assure the provision of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has approved this Amendment as to legal form. 

 

FINANCING:

This Amendment No. 3 to the Agreement will have no impact on the General Fund Contribution.
