Acting as the Board of Directors of the East Garrison Community Services District:
a. Approve Amendment No. 1 to Standard Agreement No. A-15556, by and between the East Garrison Community Services District and Al Fresco Landscape Management, Inc. to continue to provide stormwater and flood control maintenance services for the District, under Request for Proposal #10796, to increase the not to exceed amount by $300,000 for a total amount not to exceed $870,000 with no extension to the term October 6, 2021 to October 5, 2026; and
b. Authorize the Chair, or designee to execute Amendment No. 1 to Standard Agreement No. A-15556, and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors, acting as the Board of Directors of the East Garrison Community Services District:
a. Approve Amendment No. 1 to Standard Agreement No. A-15556, by and between the East Garrison Community Services District and Al Fresco Landscape Management, Inc. to continue to provide stormwater and flood control maintenance services for the District, under Request for Proposal #10796, to increase the not to exceed amount by $300,000 for a total amount not to exceed $870,000 with no extension to the term October 6, 2021 to October 5, 2026; and

SUMMARY/DISCUSSION:
East Garrison is an unincorporated community in Monterey County, California. A Community Services District (CSD) was established for the East Garrison Community in 2005. Maintenance of East Garrison Community Services District (EGCSD) facilities was provided by the East Garrison developer, UCP East Garrison LLC, under a Temporary Maintenance Agreement (Agreement No. A-12423) that expired October 5, 2021.
On October 5, 2021, the Board of Supervisors (BOS), acting as the Board of Directors (BOD) of the EGCSD, approved Standard Agreement (SA) No. A-15556 with Al Fresco Landscape Management, Inc. (Attachment A) in the amount of $570,000 to provide stormwater and flood control maintenance services within the East Garrison development for a term from October 6, 2021, through October 5, 2026.
To be able to provide ongoing as-needed stormwater and flood control maintenance services during the existing SA term, Department of Public Works, Facilities and Parks (PWFP) staff recommends that the Monterey County BOS, acting as the BOD of the EGCSD, approve Amendment No. 1 (Attachment B) to SA No. A-15556, for continued stormwater and flood control maintenance services for the EGCSD. The proposed Amendment No. 1 will increase the not to exceed amount of $570,000 by $300,000 for a total amount not to exceed $870,000 with no extension to the term ending on October 5, 2026. Anticipated costs for flood control maintenance services are included in the annual EGCSD budgets.
Attachment C provided for reference, includes a summary of the annual expenditures and balance of the SA to date.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, acting as Counsel for EGCSD, and the Auditor-Controller’s Office have reviewed and approved Amendment No. 1 as to form, and fiscal provisions, respectively.
FINANCING:
Funding for the proposed Amendment No. 1 is available in the fiscal year (FY) 2024-25 Adopted Budget and planned FY 2025-26 Budget for the EGCSD, Fund 181, Appropriation Unit PFP006. This is derived from a special tax imposed upon residential properties within East Garrison. No impact to the County General Fund will result from this recommendation.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisor’s Strategic Initiatives for Public Safety. The continued stormwater and flood control maintenance services will help safeguard the safety of the residents.
