Before the Board of Supervisors in and for the
County of Monterey, State of California
Resolution No: 10 122
A Resolution providing that past due sewer
service charges for the Pajaro County Sanitation
District be added to the County's tax rolls.
WHEREAS, the Board of Supervisors, acting as the Board of Directors of the Pajaro County
Sanitation District PCSD), has enacted an Ordinance which provides for the collection of sewer
service charges by use of a monthly billing system; and
WHEREAS, certain property owners in the PCSD Exhibit A) have allowed past due balances to
accumulate; and
WHEREAS, Ordinance No. 5054, which amends Section 16 of the PCSD, Ordinance No. 6, allows
for the collection of delinquent fees as special assessments constituting a lien on the property for the
size of such delinquent fees; and
WHEREAS, it is desirable that past due assessments for sewer service be collected.
NOW, THEREFORE, BE IT RESOLVED by the Monterey County Board of Supervisors, acting as
the Board of Directors of the Pajaro County Sanitation District, as follows:
Delinquent sewer service charges for the PCSD, as identified in Exhibit A, be added to the
Monterey County Tax Rolls.
PASSED AND ADOPTED on this 11th day of May, 2010, upon motion of Supervisor Calcagno,
seconded by Supervisor Armenta, by the following vote, to-wit:

SUBJECT: Acting as the Board of Directors of the Pajaro County Sanitation District:
a. Consider conducting a Public Hearing to consider protests and objections to

for the Pajaro County Sanitation District be added to the County's tax rolls.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
Acting as the Board of Directors of the Pajaro County Sanitation District:
a. Consider conducting a Public Hearing to consider protests and objections to a report of
delinquent accounts for the Pajaro County Sanitation District; and
b. Consider adopting a resolution providing that past due sewer service charges for the Pajaro
County Sanitation District be added to the County's tax rolls.
SUMMARY:
The proposed actions will result in placing past due sanitation assessment service charges for the
Pajaro County Sanitation District on the tax rolls to facilitate collections.
DISCUSSION:
In 1999, the Board of Supervisors approved the adoption of an ordinance for the Pajaro County
Sanitation District PCSD) establishing sanitation service charges be removed from the tax rolls
and collected through a monthly billing system. On January 9, 2007, the Board of Supervisors
adopted an ordinance establishing procedures for collecting delinquent accounts for the PCSD.
Those procedures include conducting an annual Public Hearing to hear all protests and
objections to a report of delinquent accounts Exhibit A). Property owners were notified that
they were delinquent by a letter dated February 10, 2010. The proposed action would provide
for the required hearing. Notices of the hearing were sent to affected property owners. The
accounts listed in Exhibit A and the amounts due are based on a report submitted by the
Monterey Regional Water Pollution Control Agency MRWPCA) on March 30, 2010.
OTHER AGENCY INVOLVEMENT:
The MRWPCA acts as the billing agency for the PCSD. Placement of the liens on the property
tax rolls will be done by the Treasurer-Tax Collector's Office.
FINANCING:
Collectively, past due amounts currently total approximately $46,603.26 from 90 parcels. Minor
administrative costs associated with the recommended action will be sourced from the PCSD.
