a. Approve Amendment No. 9 to Professional Services Agreement No. A-09966 with Wood Rodgers, Inc. to provide additional project management, review and processing of the environmental documents, and approval related to the Project Approval and Environmental Determination and Plans, Specifications and Estimate for the Highway 68 - Corral de Tierra Road Intersection Improvements, Project No. 114065, in the amount of $73,330 for a total amount not to exceed $741,262, and extend the term to December 31, 2014; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 9 to Professional Services Agreement No. A-09966 and future amendments that do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 9 to Professional Services Agreement No. A-09966 with Wood Rodgers, Inc. to provide additional project management, review and processing of the environmental documents, and approval related to the Project Approval and Environmental Determination and Plans, Specifications and Estimate for the Highway 68 - Corral de Tierra Road Intersection Improvements, Project No. 114065, in the amount of $73,330 for a total amount not to exceed $741,262, and extend the term to December 31, 2014; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 9 to Professional Services Agreement No. A-09966 and future amendments that do not significantly alter the scope of work or change the approved Agreement amount.
SUMMARY/DISCUSSION:
On September 28, 2004, the Board approved Professional Services Agreement (PSA) No. A-09966 in an amount not to exceed $102,205 with Wood Rodgers, Inc. to provide preliminary engineering and completion of a Project Study Report (PSR) for the Highway 68 - Corral de Tierra Road Intersection Improvements for a term from September 1, 2004 to September 1, 2006.
On May 9, 2006, the Board approved Amendment No. 1 to PSA No. A-09966 in the amount of $21,725 for a total amount not to exceed $123,930 for additional services associated with the preparation of the PSR including additional conceptual engineering studies, an additional alternative in the PSR, additional traffic analysis, additional project management activities and additional preliminary environmental review and to extend the term to December 31, 2006.
On October 10, 2006, the Board approved Amendment No. 2 to PSA No. A-09966 in the amount of $249,160 for a total amount not to exceed $373,090 for additional services associated with the development of a Project Report to complete Caltrans requirements for the Project Approval and Environmental Determination (PA&ED) phase of project development and to extend the term to December 31, 2007.
On December 7, 2007, the Contracts/Purchasing Officer executed Amendment No. 3 to PSA No. A-09966 with Wood Rodgers, Inc. to extend the term to December 31, 2008 to provide continued services associated with the development of a Project Report to complete Caltrans requirements for the PA&ED phase.
On January 7, 2009, the Contracts/Purchasing Officer executed Amendment No. 4 to PSA No. A-09966 to extend the term to December 31, 2009 due to delays in Caltrans approval of the environmental technical reports.
On March 17, 2009, the Board approved Amendment No. 5 to PSA No. A-09966 in the amount of $45,697 for a total amount not to exceed $418,787 for additional services related to the completion of the Natural Environment Study Report, the following revised documents: Conceptual Geometric Drawing, Geotechnical Design and Materials Report, Right of Way Requirements Map, Right of Way Data Sheet, Draft Project Report; and changes in the preliminary estimate of project cost. These additional services were necessary for the development of the Project Report and Environmental Document to complete Caltrans requirements for the PA&ED phase of project development.
On October 27, 2009, the Board approved Amendment No. 6 to PSA No. A-09966 in the amount of $88,685 for a total amount not to exceed $507,472 for additional services associated with the development of a Project Report and Environmental Document to complete Caltrans requirements for the PA&ED phase of project development and to extend the term to January 31, 2011. Due to changes to the status of the California Tiger Salamander that resulted in new requirements from the California Department of Fish and Game, additional studies and a United States Fish and Wildlife Service "take" permit were needed to complete the environmental documentation for the project.
On March 16, 2010, the Board approved Amendment No. 7 to PSA No. A-09966 in the amount of $160,460 for a total amount not to exceed $667,932 to provide for the Plans, Specifications and Estimate (PS&E) phase to obtain Caltrans approval of the project construction documents to widen State Route Highway 68 on the north side to either side of Corral de Tierra Road and widen Corral de Tierra Road on the east side to provide space for a second southbound lane departing the intersection and to extend the term to June 30, 2011.
On May 12, 2011, the Contracts/Purchasing Officer executed Amendment No. 8 to PSA No. A-09966 to extend the term to June 30, 2012.
Due to delays in the review, completion and formatting of environmental documents, additional time is necessary to complete Caltrans requirements for the PA&ED phase of project development for the Project, and additional time is necessary to allow sufficient time for Caltrans' approval of the PS&E of the Project. To date, there have been numerous iterations of the environmental documents submitted to Caltrans for review and approval. Currently, Caltrans has submitted yet another set of review comments.
Amendment No. 9 provides for additional project management, review and processing of the environmental documents, and approval related to the PA&ED and PS&E. Amendment No. 9 will increase this PSA by $73,330 for a total amount not to exceed $741,262 and extend the term to December 31, 2014.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Auditor-Controller, have reviewed and approved Amendment No. 9 as to form and legality, and fiscal provisions, respectively.
FINANCING:
There is no impact to the General Fund. The project is partially funded by the traffic impact fees collected from developments in the Highway 68 corridor and by State Transportation Improvement Program funds (STIP). Amendment No. 9 will be funded by both traffic impact fees administered by the Transportation Agency for Monterey County (TAMC) and by funds provided by the Regional Surface Transportation Program (RSTP). Sufficient appropriations are available in the RMA-Public Works Road Fund (Fund 002, Unit 8195) to finance Amendment No. 9.
