RECOMMENDATION:
It is recommended that the Board of Supervisors:
Ratify authorization for the Chief Probation Officer to sign the Memorandum of Understanding between the South Bay Information Sharing System (SBISS) South Bay Region Node and the County of Monterey Probation Department effective November 20, 2012.
 
SUMMARY:
In order to ensure the Probation Department's participation in the South Bay Information Sharing System (SBISS) South Bay Region Node, the Chief Probation Officer signed a Memorandum of Understanding prior to the Board of Supervisor's approval to meet the deadline for submission of a continuation grant that will fund the project. This action seeks to ratify the Chief Probation Officer's signature authorization.
 
DISCUSSION:
The Office of Homeland Security allocated grant funds to SBISS South Bay Region Node for the purpose of sharing criminal justice data utilizing a software application known as "COPLINK".  Santa Clara County, Office of the Sheriff has been approved and directed by the Urban Areas Security Initiative (UASI) as the lead agency of this grant.
 
An executed MOU dated March 16, 2010 between Police Agencies and the Sheriff's Office in the jurisdictional boundaries of the County of Monterey agree to share criminal justice data between Santa Clara County, San Benito County, Santa Cruz County and Monterey County. The MOU is amended to expand services by adding Probation Departments within the same jurisdictions to participate in this regional information sharing system. Monterey County Probation has been added as a participant effective November 20, 2012.
 
The purpose of the "COPLINK" software application is to allow for the collection and analysis of criminal justice data to include, but not necessarily limit to crime and miscellaneous report summaries, field interviews and contacts, vehicle accidents, arrest records, citations, arrest photos and other data collected by each law enforcement agency. The "COPLINK" software receives all the data from each agency and deposits it into a data repository.  Each agency then has access to use this analysis software and the data contained in the repository to perform law enforcement duties. All data is available to the participating law enforcement agencies only and will not be available to the public. All data is considered confidential and all employees granted access to the data will be required to sign employee statement forms acknowledging their responsibility to protect the data.
The grant allows for the setup of the Probation module and software licensing costs through April 30, 2015.
 
OTHER AGENCY INVOLVEMENT:
The County Counsel has reviewed the Memorandum of Understanding prepared on behalf of the parties and has approved it to form.  
 
FINANCING:
The Probation software module, integration maintenance, and costs are paid by the Homeland Security grant through April, 30, 2015.
 
If Probation agrees to continue participation after the grant funding period expires, the estimated cost to the Probation Department shall be approximately $4,897 for the annual maintenance and host site.
