Adopt a Resolution to:

a.  Establish a Road Fund Advisory Committee; and

b.  Adopt the Road Fund Advisory Committee Bylaws.

Report

RECOMMENDATION:

It is recommended that the Board of Supervisors adopt a resolution:

a.                     Establishing a Road Fund Advisory Committee; and

b.                     Adopting the Road Fund Advisory Committee Bylaws.

 

SUMMARY/DISCUSSION:

In June 2013, the Board of Supervisors (Board) approved including the Road Fund as a beneficiary in the County Transient Occupancy Tax (TOT) Revenue contribution formula.  On March 11, 2014, the Board approved revision to the Fiscal Year (FY) 2014-15 County Financial Policies that includes a policy to fund the Road Fund through a County TOT contribution formula in a graduated process from 20% up to a flat rate contribution of 25% to maintain roads.  At that time, a policy was also approved to implement a Road Fund Advisory Committee (Advisory Committee) to provide direction on the use of these funds and the Resource Management Agency (RMA) was designated as the County department to support the Advisory Committee.  A copy of the Board Order and applicable policy language is included as Attachment 1, County Financial Policies FY 2014-15 Revision.

 

This ten (10) member Advisory Committee shall be responsible per annum to review the recommendations from the RMA on the use of the TOT funds on County roads.  When the RMA provides a plan for the use of this funding to the Board and their respective committees, minutes from the Advisory Committee shall be included for consideration.

 

Each Supervisor is requested to appoint two (2) members that would represent their respective Districts.  In accordance with the General Financial Policies, members “shall be residents of an unincorporated area of the County.”  Staff interprets that this policy would not limit appointments to any specific Supervisorial District, but they must reside (not just own property) within the unincorporated County area (not within an incorporated City boundary).  Specific appointments for consideration are not part of this action.  Members would be appointed at a subsequent Board meeting under appointments. 

 

The General Financial Policies language also states that the “Advisory Committee does not replace the functions and responsibilities of both the Capital Improvement and Budget Committees.”  Staff interprets this to mean that the Advisory Committee would make recommendations that are forwarded to these Board Committees. 

 

To facilitate the Committee meetings and streamline its function, staff has drafted Committee Bylaws found for consideration by the Board (Attachment 2 and 2A).  These proposed Bylaws are consistent with Resolution No. 80-12, the Board policy relative to Committees and Commissions (Attachment 3).  Staff recommends that the Board adopt the resolution establishing the Road Fund Advisory Committee and its bylaws. 

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel has reviewed and approved the proposed Resolution and Committee Bylaws as to form.

 

FINANCING:

There is no impact to the General Fund.  Cost associated with time for staff activities related to Committees and Commissions are included in the FY15/16 Budget.
