RECOMMENDATION:
It is recommended that the Board of Supervisors:
Adopt a Resolution Authorizing the Monterey County Sheriff's Office to add the federal level criminal history summary checking to the existing State level criminal history checking for City/County Employment, Volunteers and Vendors through the California Department of Justice.

SUMMARY/DISCUSSION:
The Monterey County Sheriff's Office (MCSO) currently runs a State summary criminal history check on everyone who is fingerprinted by its office. Per penal code section 11105, MCSO is authorized to include a federal criminal history check with the State summary criminal history check for City/County Employees, vendors and volunteers. But this requires a resolution to be submitted to the California Department of Justice.

Once the resolution has been submitted and approved, the California Department of Justice may also then transmit fingerprint images and related information to the Federal Bureau of Investigation. Transmission of the fingerprint images and other related information to the FBI will allow for the identification of individuals who have committed crimes outside of the State of California. This information can then be used when making decisions to fulfill employment, licensing, or certification purposes.
