RECOMMENDATION:
It is recommended that the Board of Supervisors:

a. Approve the Landscape Maintenance Agreement with Caltrans for the Highway 68 at Highway 1 roundabout project including non-standard insurance and indemnification provisions;

b. Authorize the Chair of the Board to execute the Landscape Maintenance Agreement; and

c. Direct the Director of RMA to submit the fully executed Landscape Maintenance Agreement to the County Recorder for filing.

SUMMARY/DISCUSSION:
The Holman Highway 68 Roundabout project proposes to make safety and operational improvements along Highway 68 in the Peninsula of Monterey County and will relieve congestion at the busy intersection of Holman Highway 68, Highway 1 ramps and 17 Mile Drive near the entrance to Pebble Beach and the Community Hospital. This project is the result of a collaborative effort and a public-private partnership between the City of Monterey, Pebble Beach Company, Monterey Bay Unified Air Pollution Control District, County of Monterey, the Transportation Agency for Monterey County (TAMC), and the California Department of Transportation (Caltrans). Construction is expected to begin mid-late June 2016.

County staff is recommending the approval of aforementioned Landscape Maintenance Agreement to establish the roles and maintenance responsibilities of the County and Caltrans.

OTHER AGENCY INVOLVEMENT:
The subject Landscape Maintenance Agreement, initially proposed by Caltrans, includes non-standard mutual indemnification and insurance language.
