RECOMMENDATION:
It is recommended that the Board of Supervisors:

a. Approve the Castroville Boulevard Warranty Agreement with The Don Chapin Company in compliance with condition of warranties for the Castroville Boulevard Overlay Project, Project No. 14-157165; and

b. Authorize the Public Works Director to execute the Castroville Boulevard Warranty Agreement.

SUMMARY/DISCUSSION:
On June 3, 2014, the Monterey County Board of Supervisors approved the contract for the Castroville Boulevard Overlay Project (Project No. 14-157165) to grind and overlay the existing pavement from State Highway 156 to San Miguel Canyon Road. During construction a section of the new hot mix asphalt (HMA) that was placed was out of compliance with respect to the specification for HMA Stabilometer Values (California Test 366) set forth in Standard Specifications Section 39-1.03B, "Stability Specifications". Stabilometer test results are indicative of the HMA susceptibility to pavement rutting. After final review of the lab test results with the Contractor, The Don Chapin Company, and the material supplier, Granite Construction, it was agreed to enter into a Warranty Agreement to monitor and extend the warranty on the out of compliance pavement section. The warranty for this road section will be extended from the one (1) year warranty typical of construction projects to a period of eight (8) years. The Warranty Agreement specifies monitoring of the pavement section including annual inspections and specific warranty measures. The Warranty Agreement requires a performance bond in the amount of $250,000 to guarantee the performance of any work under the Agreement.
