Department of Emergency Management.

Report
RECOMMENDATION:
It is recommended that the Board of Supervisors, as the code reviewing body, approve the
newly established Conflict of Interest Code for the Department of Emergency Management.

SUMMARY:
Following its establishment as an independent department, the Department of Emergency Management has adopted a Conflict of Interest Code as required by Government Code section 87300.The Department of Emergency Management seeks Board approval of its newly established Conflict of Interest Code, which is attached hereto.

DISCUSSION:
Under Government Code section 87300, "[e] very agency shall adopt and promulgate a Conflict of Interest Code . . . ." The Department of Emergency Management was recently established as an independent County department. Consequently, it is required to adopt and promulgate its own Conflict of Interest Code.

Pursuant to sections 82011 and 887303 of the Government Code, the Board of Supervisors is
the code reviewing body. It may approve the Code as submitted; revise the proposed code and
approve it as revised; or return the proposed Code to the agency for revision and resubmission.
The proposed Code, as established and submitted, is lawful under the Political Reform Act of
1974.

OTHER AGENCY INVOLVEMENT:
County Counsel recommends that the Board approve the newly established Conflict of Interest Code as submitted.

FINANCING:
There is no fiscal impact upon the County of Monterey resulting from the Board's approval of
the newly established Conflict of Interest Code.

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
Approval of the established Conflict of Interest Code fulfills the Board's statutorily designated role as the code reviewing body pursuant to the Political Reform Act.
