RECOMMENDATION:
It is recommended that the Planning Commission adopt a resolution to:
1) Find that consideration of a fee waiver is not a “Project” pursuant to CEQA Guidelines section 15378 and Public Resources Code section 21065
2) Deny the Fee Waiver Request to waive permit fees associated with HCD-Planning File No PLN240181.
The attached draft resolution includes findings and evidence for consideration (Exhibit A).

The project site is located at 554 Maher Road, Royal Oaks, within the North County Land Use Plan. HCD-Planning File No. PLN240181 has been proposed to partially abate an existing code enforcement case (21CE00071), through legalizing after-the-fact works consisting of: conversion of a 1,369 square foot barn into a residence, construction of a 528 square foot bedroom addition and 278 square foot covered porch, construction of 566 square foot garage, conversion of an existing garage to a 425 square foot guesthouse and unpermitted development on slopes in excess of 25 percent.
