a. Accept a Grant of Public Utility Easement over a portion of APN 031-164-129 from UCP East Garrison, LLC, a Delaware limited liability company for purpose of ingress and egress, and constructing, maintaining, using, and operating utility connections in conjunction with the East Garrison Development Project on the former Fort Ord;
b. Authorize the Chair to execute the Certificate of Acceptance and Consent to Recordation for the Grant of Public Utility Easement; and
c. Authorize the Director of Public Works to submit the executed Grant of Public Utility Easement to the County Recorder for recordation.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Accept a Grant of Public Utility Easement over a portion of APN 031-164-129 from UCP East Garrison, LLC, a Delaware limited liability company for purpose of ingress and egress, and constructing, maintaining, using, and operating utility connections in conjunction with the East Garrison Development Project on the former Fort Ord;
b. Authorize the Chair to execute the Certificate of Acceptance and Consent to Recordation for the Grant of Public Utility Easement; and
c. Authorize the Director of Public Works to submit the executed Grant of Public Utility Easement to the County Recorder for recordation.
SUMMARY:
Acceptance of the Grant of Public Utility Easement (Easement) will provide the County with access to a portion of property owned by UCP East Garrison, LLC, a Delaware limited liability company (UCP) in the “Phase 3” area of East Garrison for the purpose of ingress and egress to construct, maintain, use, and operate public utilities as part of the infrastructure necessary to serve development of the Phase 1 area of the East Garrison Development Project (Project).
