Adopt an ordinance amending Chapter 7.90 of the Monterey County Code to make administrative changes including, but not limited to, clarifying commercial cannabis operation requirements, updating fee and refund provisions, revising on-site tobacco provisions, and establishing cessation of business requirements.
SUMMARY/DISCUSSION
Pursuant to Monterey County Code (MCC) Chapter 7.90, businesses conducting commercial cannabis activities within the unincorporated area of Monterey County must obtain a commercial cannabis business permit. In early 2019, oversight of this permit was transferred to the Monterey County Cannabis Program. Since that time, three ordinances amending the chapter have been adopted by the Board of Supervisors (Board) to permit an annual canopy modification, modify requirements for criminal background checks, and authorize an additional, annual canopy modification.
The Program maintains an evolving list of proposed amendments to Chapter 7.90, determined by lessons learnt from administering the chapter, feedback received during cannabis industry meetings, and changes required by the consolidation of the three state cannabis licensing bureaus. The draft ordinance amendment before the Board today would clarify operational requirements and procedures and permit cannabis-related business employees to consume tobacco or nicotine products in designated areas.
