RECOMMENDATION:
It is recommended that the Board of Supervisors:
1. Approve Amendment and Restatement of the Monterey Peninsula Regional Water
Authority Governance Committee Agreement.
2. Authorize the Chair to execute Amended Agreement

SUMMARY:
At its February 12, 2013 meeting, your Board approved the Agreement to form Monterey Peninsula Water Supply Project Governance Committee. This agreement established a governance committee for the Cal-Am desalination project comprised of the Monterey Peninsula Water Management District, the Monterey Peninsula Regional Water Authority, the County of Monterey and Cal-Am. The agreement also created a process by which certain project-related decisions would be made.

One of the projects for consideration is Groundwater Replenishment, or GWR. As a result of the ongoing proceedings at the California Public Utilities Commission (CPUC) in CPUC A.12.04.019, the parties agreed to bifurcate the review of the Groundwater Replenishment (GWR) project into a separate proceeding starting in late 2014. As a result, the decision-making with respect to GWR will change and the governance agreement requires amending to so reflect. This change required language revision and moving the clause to a later part of the Governance Agreement. However, no substantive change was made to the intent of the clause. Attached for your reference is the revised and deleted language, the original agreement and the Amended agreement.
