a. Approve and authorize the Director of Health to sign Amendment No. 2 to the County of Monterey Standard Agreement with Keith Vandevere, Attorney-At-Law to serve as the hearing officer for certification review hearings under the mandated Lanterman-Petris-Short Act; and to increase the existing Agreement amount by $6,000 for Fiscal Year (FY) 2014-15, and $21,000 for FY 2015-16 for a new total contract amount not to exceed $144,000; and
b. Authorize the Director of Health to sign up to two future amendments to this Agreement where the amendments do not exceed ten percent (10%) of the total contract amount and do not significantly change the scope of work.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of Health to sign Amendment No. 2 to the County of Monterey Standard Agreement with Keith Vandevere, Attorney-At-Law to serve as the hearing officer for certification review hearings under the mandated Lanterman-Petris-Short Act; and to increase the existing Agreement amount by $6,000 for Fiscal Year (FY) 2014-15, and $21,000 for FY 2015-16 for a new total contract amount not to exceed $144,000; and

SUMMARY/DISCUSSION:
The Lanterman-Petris-Short Act mandates a certification review hearing for all persons to be certified for involuntary mental health treatment. Keith Vandevere, Attorney-At-Law, provides services as the hearing officer for certification review hearings. The number of persons requiring certification review hearings has increased. The proposed Amendment No. 2 increases the annual number of hearings to be provided and the total Agreement amount to meet the increased need for certification review hearing officer services.
