Closed Session under Government Code section 54950, relating to the following items:
a. Pursuant to Government Code section 54956.9(d)(1), the Board will confer with legal counsel regarding existing litigation:
(1) Carmel Rio Road LLC v. County of Monterey (Monterey County Superior Court case no. M118773)
(2) County of Monterey v. Nova Partners, Inc., et al. (Santa Clara County Superior Court case no. 1-10-CV-178283)
(3) Julian Serrato, et al. v. Monterey County, et al. (United States District Court, California Northern District case number 5:11-cv-03642RMW
(4) Rita Serrato, et al. v. County of Monterey, et al. (United States District Court, California Northern District case number 5:11-cv-04106RMW
b. Pursuant to Government Code section 54957(b)(1), the Board will provide a performance evaluation for the County Counsel.
c. Pursuant to Government Code section 54956.9(d)(2), the Board will confer with legal counsel regarding one matter of significant exposure to litigation.
d. Pursuant to Government Code section 54957.6, the Board will confer with labor negotiators:
(1) Designated representatives: James May and Brette Neal
Employee Organizations: All Units
e. Pursuant to Government Code section 54957(b)(1), the Board will provide a performance evaluation for the Natividad Medical Center CEO. (ADDED VIA ADDENDUM)
f. Pursuant to Health & Safety Code section 1462, the Board will receive a report and confer regarding health care facility/hospital trade secret. Discussion will concern a new facility and program. (ADDED VIA ADDENDUM)
g. Pursuant to Government Code section 54956.9(d)(4), the Board will confer with legal counsel regarding one matter of potential initiation of litigation. (ADDED VIA ADDENDUM)
