RECOMMENDATION:
It is recommended that the Board of Supervisors:
Adopt a Resolution approving amendments to Conflict-of-Interest Code of the Elections Department of the County of Monterey.
SUMMARY/DISCUSSION:
The Political Reform Act of 1974 (Government Code section 81000, et. seq.), requires state and local government agencies to adopt Conflict-of-Interest Codes and to periodically review and make necessary changes to their codes. The Elections Department wishes to amend its Conflict-of-Interest Code to add one designated position to reflect recent changes in organization and employee responsibilities. Amendments to local agency Conflict-of-Interest Code are authorized by section 87306 of the Government Code whenever changes are required by changed circumstances, by creation or deletion of designated positions, or by changes in the duty of such positions.
Pursuant to Government Code sections 82011 and 87303, the Board of Supervisors is the code reviewing body. It may approve the Code as submitted, revise the proposed Code and approve it as revised, or return the proposed Code to the Elections Department for revision and resubmission. The proposed, amended Code is attached for review and approval. Staff recommends that the Board of Supervisors approve the proposed amended Elections Department of the County of Monterey Conflict-of-Interest Code.
OTHER AGENCY INVOLVEMENT:
The County Counsel’s office has reviewed the proposed Code, as submitted and concluded that it is lawful under the Political Reform Act of 1974.
FINANCING:
There will be no additional cost to the County General Fund resulting from the Board’s approval of the proposed amendment to the Elections Department of the County of Monterey Conflict-of-Interest Code.
