RECOMMENDATION:
1. Ratify and Approve the Action of the CAO to Review and Terminate the status of the Local Emergency near the Moro Cojo Slough.
2. Approve a Proclamation Terminating a Local Emergency near the Moro Cojo Slough.

SUMMARY:
On November 3, 2015, the Board adopted Resolution No. 15-101, which proclaimed an emergency relating to a failure in the flap gate and culvert system underneath Moss Landing Road in the Moro Cojo Slough.

Approval of the emergency proclamation allowed for temporary repairs to be made to the culvert system and for these temporary repairs to be maintained while a permanent solution is designed.

DISCUSSION:
Those temporary repairs have been made and a separate MOU between the County/RMA and the Monterey County Water Resources Agency has been negotiated to develop and implement a permanent solution. That MOU will be separately presented to the Board for action. The County Administrative Officer, in the absence/unavailability of the Board of Supervisor to take action, in consideration of the actions taken by the County and the MCWRA to address the issues that gave rise to the emergency proclamation, and pursuant to the reviewing requirements of Government Code section 8630, declared termination of the emergency at Moro Cojo Slough on January 14, 2016.

Accordingly, it is recommended that the Board ratify the action of the County Administrative Officer and formally terminate the proclamation of emergency by adopting the attached Resolution.
