RECOMMENDATION:
It is recommended that the Board of Supervisors adopt a resolution approving and authorizing the County Administrative Officer or designee to execute a Proposition 218 Ballot and submit a “Yes” vote for the City of Monterey’s proposed 2026 Flood Protection and Clean Storm Water Fee which affects County-owned real property located at 1200 Aguajito Road, Monterey, California, prior to the July 6, 2026 deadline.

SUMMARY:
In its capacity as the property owner, the County of Monterey (County) needs to submit a Proposition 218 mail-in ballot by July 6, 2026. The City of Monterey (City) is proposing to establish a new monthly flood protection and clean storm water fee which affects County-owned real property located at 1200 Aguajito Road, Monterey, California, APN 001-781-013-000 (subject property). The proposed monthly fee of $180 for the subject property is approximately $2,160 per year, adjusted annually.

DISCUSSION
The City has initiated Proposition 218 mail-in ballot proceeding to establish a new monthly flood protection and clean storm water fee. The proposed new fee will affect the subject property. According to information provided by the City, its stormwater reserve fund will be depleted in fiscal year 2026/27, and the proposed fee enables the City to establish a dedicated funding source for ongoing stormwater operations and maintenance. Proposed fees are allocated to property owners based on each property’s contribution to stormwater runoff.
