RECOMMENDATION:
It is recommended that the Board of Supervisors:
Continue the public hearing regarding amendments to the 2010 Monterey County General Plan (Carmel Valley Master Plan) to implement a litigation settlement with the Carmel Valley Association to February 12, 2013.
SUMMARY:
On December 4, 2012, a noticed public hearing before the Board of Supervisors was scheduled to consider amendments to the 2010 Monterey County General Plan (Carmel Valley Master Plan) to implement a litigation settlement with the Carmel Valley Association. The matter was continued to a date uncertain in January of 2013. A copy of the Board Order to that effect is enclosed as Attachment A. Staff is recommending that the matter be further continued to February 12, 2013, to be heard along with proposed amendments to the 2010 General Plan to implement a litigation settlement with the Salinas Valley Water Coalition and Monterey County Farm Bureau, et al. (“SVWC”).
DISCUSSION:
The 2010 General Plan limits Board consideration of General Plan amendments to twice per calendar year (state law is more permissive, and allows consideration of amendments four times per year), thus staff recommends that both settlement implementation proposals be considered during the same meeting in order to preserve a second opportunity for the Board to consider other General Plan amendments later in the year. The Planning Commission has considered both settlements, and has made its recommendations; however, the SVWC settlement will be presented to the Agricultural Advisory Committee on January 24, 2013, and staff is proposing that both matters be considered by the Board on February 12, 2013. Both matters will be formally noticed for the hearing on February 12.
