RECOMMENDATION:
It is recommended that the Board of Supervisors:
Adopt a Resolution confirming the appointment of Mr. Gene Rogers as Interim Assistant County Administrative Officer
 
SUMMARY/DISCUSSION:
Recent changes to the California Government Code have modified the conditions under which retired annuitants with the California Public Employees Retirement System ("PERS") may be employed by PERS contract agencies such as the County.  With respect to interim positions, such as interim department heads, PERS now requires that such appointments be made only in circumstances where there is a recruitment that will be conducted to fill the vacancy.  The appointment also needs to be accompanied with a resolution containing certain information about the nature of the appointment, including the position, limit on hourly pay, limit on hours worked (up to 960 per FY), that a valid recruitment is being conducted, and other information.  The attached resolution addresses requirements of the Government Code.  
 
A key assignment of the Interim Assistant CAO will be to work on the transition of the Economic Development Department, which is in part forced by the State's elimination of redevelopment agencies and the recent retirement of its director.  The Interim Assistant CAO will also provide leadership and staff support to the Department as required.  In addition, he will perform other duties as assigned by the CAO.  The Assistant CAO position is in the FY12/13 Budget.
 
OTHER AGENCY INVOLVEMENT:
The CAO, Human Resources staff, and County Counsel reviewed and assisted in preparation of this report.
 
FINANCING:
This action does not have any impact upon the General Fund. The Assistant CAO position is budgeted.
