RECOMMENDATION:
It is recommended that the Board of Supervisors introduce, waive reading and adopt an urgency ordinance creating "no parking tow away" and "no parking $250 fine" zones along portions of Elm Avenue and Arroyo Seco Road in the unincorporated area near the Elm Avenue Bridge where it crosses the Arroyo Seco River (4/5ths vote required).

SUMMARY/DISCUSSION:
The area around the Elm Avenue Bridge where it crosses the Arroyo Seco River (commonly known as the "Green Bridge") has become a popular location for people to park cars and descend to the river for recreation (the area of the river is private property). This has created two urgent problems: 1) people park in such a way along Elm Avenue and Arroyo Seco Road as to block travel lanes and sight distance, both causing hazards to the public otherwise travelling along the roads and unsafe turn movements, and endangering pedestrian traffic; and 2) the deposit of large amount of trash and debris adjacent to the river and the roads, creating unhealthy conditions and potentially polluting the river.

RMA staff has identified the most impacted areas along both Elm Avenue and Arroyo Seco Road, and the immediate imposition of "no parking tow away" and "no parking $250 fine" zones are critical to the public health, safety and welfare due to the current hot weather conditions and upcoming Labor Day holiday that will entice the public to come to the area to recreate.

An urgency ordinance is proposed in order to take effect immediately; staff will process a due course ordinance to amend the County Code in the future as appropriate.
